MINUTES <br />CITY COUNCIL <br />SEPTEMBER 26, 2007 <br />Roston felt that evaluation will show there is not undue hardship to <br />warrant granting a Variance for a cul-de-sac longer than 500 feet. Roston <br />felt there was no provision in the City's Code to process a temporary cul- <br />de-sac without a Variance. Roston questioned what is considered <br />temporary. He noted that it is unlikely that the proposed stub connections <br />will be developed within the next few years. <br />Roston stated that the City's Code is a set of rules and these rules haue to <br />be applied uniformly. Roston pointed out that in addition to the legal <br />issues, a traffic engineer was asked to look at this development as well. <br />Roston noted that the Council has James Benshoofls report and resume <br />and asked that it be entered as part of the public record. <br />James Benshoof, traffic engineer representing Mr. and Mrs. Gores and <br />some of the adjacent neighbors to proposed Richie Place, reviewed his <br />resume as well as his September 26, 2007 traffic report relative to the <br />proposed development. The report addressed traffic safety implications <br />relative to the proposed cul-de-sac. Benshoof noted the question of safety <br />on a cul-de-sac longer than 500 feet and asked if the City can be assured <br />that the road would be extended. <br />Benshoof noted recent discussions relative to cul-de-sac length in a <br />concept review for development of the Steinert property. During that <br />review the City Planner noted concerns with emergency vehicle access on <br />cul-de-sacs longer than 500 feet. <br />Benshoof reported that he has visited the Richie Place site and looked at <br />the topography of the property. His conclusion was that there are traffic <br />safety concerns with the cul-de-sac length property, and noted that there <br />are not assurances as to when the cul-de-sac would be extended. <br />Benshoof noted that what is before the Council for review is a cul-de-sac <br />of 1,050 feet in length, not a temporary cul-de-sac. <br />Blesener reported that he has lived on a cul-de-sac that is considerably <br />longer than the one proposed for the past 39 years, and there have been no <br />issues of concern. Blesener noted that the City Council has the opinion of <br />the City Attorney, City Engineer, and City Planner that this is a temporary <br />cul-de-sac, thus exempt from the 500-foot limitation. <br />Montour indicated that his biggest concern is the additional traffic that <br />would be added to LaBore Road. Montour noted that Mr. Benshoof did <br />not address this as a concern in his report. Benshoof stated that the <br />addition of traffic from 16 single-family lots onto LaBore Road would not <br />be a problem. <br />12 <br />
