MINUTES <br />CITY COUNCIL <br />SEPTEMBER 26, 2007 <br />The City Administrator noted the workshop that is planned for October <br />24`x' to review proposed Zoning Code amendments. He suggested that the <br />topics of large lot zones, cul-de-sac length, tree preservation, and <br />environmental issues should be discussed at that workshop. <br />Keis stated that his concern is with 6,000 square foot homes on 10,000 <br />square foot lots. The Planner indicated that the City can limit lot <br />coverage, but noted that the result is smaller homes. <br />The City Attorney noted that the Dayspring Development litigation <br />resulted in a complete dissection of the Little Canada Subdivision Code. <br />The Attorney noted that the City's Code must be specific in order for the <br />court to uphold a City Council action. While individual Council Members <br />can have personal objections to a development, the courts will not uphold <br />actions based on personal objections. The Attorney indicated that if the <br />Council's decision is to deny the Richie Plat, specific Code provisions will <br />have to be identified as findings of fact to support that denial. If one of <br />the reasons for denial is that the area is environmentally sensitive, then <br />that must be defined. <br />McGraw noted that whatever Codes are in place at the time a developer <br />applies for a plat are the Codes that must be complied with. Therefore, <br />creating a zoning district with larger lots would not apply to the Richie <br />Plat presented this evening. McGraw also commented that to say the <br />development is out of character with the neighborhood was not valid, in <br />his opinion, given that many of the houses and lots in that area have been <br />there for the past 40 years or longer. McGraw pointed out that any <br />development in this area will change the footprint of the neighborhood. <br />ZONING Mr. Blesener introduced the following resolution and moved its adoption: <br />CODE <br />WORKSHOP RESOLUTION NO. 2007-9-242 -CALLING FOR A WORKSHOP <br />MEETING MEETING OF THE CITY COUNCIL AND THE PLANNING <br /> COMMISSION FOR WEDNESDAY, OCTOBER 24, 2007AT 5:30 <br /> P.M. TO REVIEW PROPOSED ZONING CODE AMENDMENTSAS <br /> WELL AS THE CONCEPT REVIEW PROCESS <br />The foregoing resolution was duly seconded by Allan. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />ADOPTION The City Administrator noted a presentation that was made to the Ramsey <br />OF County League of Local Governments relative to the adoption of financial <br />23 <br />
