MINUTES <br />CITY COUNCIL <br />DECEMBER 3, 2007 <br />The Administrator pointed out that property owners have rights. <br />However, owners have agreed to terms of CUPS and are not in compliance <br />with those terms. The City has the option of revoking CUPS, has done so <br />with one, and may be starting the process with another. The Administrator <br />noted that property owners have made commitments to the City, and the <br />City is asking that they honor those commitments. <br />Russ Fischer pointed out the outdoor storage issue and noted that his work <br />vehicles are parked on his property overnight. Fischer indicated that the <br />vehicles are part of his work tools and he needs to have them on the <br />property. Fischer questioned the classification of work vehicles as <br />outdoor storage. <br />The City Adminish•ator indicated that trucks larger than passenger <br />vehicles are technically considered outdoor storage. The Administrator <br />noted that this parking is potentially permissible under a CUP. However, <br />parking areas would be designated and not subject to flexibility. The <br />Administrator also noted that when tenants change and storage types <br />change, CUPS need to be amended to reflect the current situation. <br />Fischer reported that he always sends potential new tenants to the City to <br />determine if their use is permitted and what they need to do to be in <br />compliance. Fischer stated that a lot has changed in the park, and the <br />property owners are not against change. He indicated, however, that he <br />needs a place to store his trucks. <br />The Administrator indicated that the intent is not to eliminate outdoor <br />storage. He pointed out that the ideal would be if the entire park were <br />redeveloped. Given that this is unlikely, the City needs to get a handle on <br />the outdoor storage. <br />McGraw pointed out that each of the owners has a different business and <br />different needs. The City has one need and writes the rules to govern <br />everyone. McGraw stated that it was not his intent to harm any of the <br />businesses in Ryan Industrial Park, but indicated that he does not want <br />conditions in the Park to get any worse. McGraw stated that he would like <br />the entire Park to be as good as the good properties. McGraw pointed out <br />that the businesses must comply with their CUPS, and when businesses <br />change and there is the need, the CUPs must be amended. McGraw felt <br />that if each of the business owners addressed the condition of their <br />properties, this would take care of the City's problems in the Park. <br />McGraw noted that there is some good redevelopment occurring along <br />Country Drive, and reported that it appears the former Knox building will <br />be redeveloped as well. These developers have expressed concern about <br />the condition of Ryan Industrial Park. <br />
