MINUTES
CITY COUNCIL
MARCH 26, 2007
painting. He stated that they would do auto body repair work on vehicles
with good drive trains.
Keis pointed out that the auto repair work being proposed is much more
than what was originally thought. McGraw pointed out that at the
Planning Commission meeting the indication was that Voyageur would be
doing some part replacement. There was no mention of front end or rear
end work. McGraw stated that based on the presentation at the Planning
Commission meeting, he did not realize that the request was for major
auto repair. McGraw felt that the business changes are quite different
from the original intent of the CUP that was approved.
Liponiga stated that the extent of the business was presented at the
Planning Commission meeting. However, he did not have the benefit of
the interior drawings that he presented to the Council this evening.
The City Clerk indicated that at the Planning Commission it was presented
that an interior lift would be installed. It was not until the Deputy Fire
Marshal conducted an inspection of the business several days after the
Planning Commission meeting that staff learned that a frame straightening
machine was also being proposed. The City Administrator indicated that
it is his understanding that the State license for interior retail sales requires
that there be interior display spade for five vehicles.
Liponiga indicated that even with the lift and the frame straightening
machines, five vehicles could be stored in the building.
Keis posed the question that if everything is conducted indoors and there
is no outdoor storage should the City care. Allan stated that she felt what
was proposed was too large for the building, and noted the Deputy Fire
Marshal's report which indicates that there is already outdoor storage
violations occurring.
There was no one present from the general public wishing to comment on
this matter.
Upon motion by Allan, seconded by McGraw, the public hearing was
closed.
Ms. Allan inri•oduced the following resolution and moved its adoption:
RESOLUTIONNO. 2007-3-69 -DENYING THE AMENDMENT TO
CONDITIONAL USE PERMIT TO ALLOW OUTDOOR STORAGE
AS WELL AS MOTOR VEHICLE REPAIR IN CONJUNCTION WITH
ANAUTO SALES (INDOOR) LICENSE FOR VOYAGEUR MOTORS
