MINUTES <br />CITY COUNCIL <br />MAY 9, 2007 <br />keep the Council informed of his findings as well as discussions with On- <br />Site Sanitation. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2007-5-116 -APPROVING THE ON-SITE <br />SANITATION COMPLETE RELEASE AND SATISFACTION OF <br />ALL CLAIMS AND A UTHORIZING THE MAYOR TO EXECUTE ON <br />BEHALF OF THE CITY <br />The foregoing resolution was duly seconded by Allan. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />TWIN LAKE The Superintendent reported that the Sheriffls Department has received <br />PROPERTY - noise complaints of ATVs and motorbikes driving on the trail on the <br />NO City's Twin Lake Blvd. property. The Sheriffls Department has <br />TRESPASSING indicated that they cannot ticket violators unless the property is posted <br />SIGNAGE as private. The Superintendent reported that there is also illegal dumping <br />that occurs on the property. <br />Montour asked if the City could post property it owns as private. The City <br />Attorney indicated that it could not, however, no trespassing signs could <br />be posted. <br />Ms. Allan introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2007-5-117 -AUTHORIZING THE PUBLIC <br />WORKS SUPERINTENDENT TO POST THE CITY'S TWINLAKE <br />BLVD. PROPERTY WITH NO TRESPASSING SIGNS AS <br />REQUESTED BY THE RAMSEY COUNTY SHERIFF'S <br />DEPARTMENT <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />1033 LETTER - Blesener noted that the City recently purchased property at 91 Viking <br />91 VIKING Drive to provide for the re-alignment of Viking Drive from Rice Street <br />DRIVE to Minnesota Avenue. The former property owners have now requested <br />that the City issue them a 1033 Letter which indicates that the acquisition <br />was done under threat of eminent domain. Blesener noted that the letter <br />will give the seller additional time to make a "like kind" property <br />exchange in order to avoid capital gain taxes. Blesener asked if the <br />6 <br />
