MINUTES CITY COUNCIL MAY 9, 2007 keep the Council informed of his findings as well as discussions with On- Site Sanitation. Mr. Montour introduced the following resolution and moved its adoption: RESOL UTION NO. 2007-5-116 -APPROVING THE ON-SITE SANITATION COMPLETE RELEASE AND SATISFACTION OF ALL CLAIMS AND A UTHORIZING THE MAYOR TO EXECUTE ON BEHALF OF THE CITY The foregoing resolution was duly seconded by Allan. Ayes (4). Nays (0). Resolution declared adopted. TWIN LAKE The Superintendent reported that the Sheriffls Department has received PROPERTY - noise complaints of ATVs and motorbikes driving on the trail on the NO City's Twin Lake Blvd. property. The Sheriffls Department has TRESPASSING indicated that they cannot ticket violators unless the property is posted SIGNAGE as private. The Superintendent reported that there is also illegal dumping that occurs on the property. Montour asked if the City could post property it owns as private. The City Attorney indicated that it could not, however, no trespassing signs could be posted. Ms. Allan introduced the following resolution and moved its adoption: RESOLUTION NO. 2007-5-117 -AUTHORIZING THE PUBLIC WORKS SUPERINTENDENT TO POST THE CITY'S TWINLAKE BLVD. PROPERTY WITH NO TRESPASSING SIGNS AS REQUESTED BY THE RAMSEY COUNTY SHERIFF'S DEPARTMENT The foregoing resolution was duly seconded by Keis. Ayes (4). Nays (0). Resolution declared adopted. 1033 LETTER - Blesener noted that the City recently purchased property at 91 Viking 91 VIKING Drive to provide for the re-alignment of Viking Drive from Rice Street DRIVE to Minnesota Avenue. The former property owners have now requested that the City issue them a 1033 Letter which indicates that the acquisition was done under threat of eminent domain. Blesener noted that the letter will give the seller additional time to make a "like kind" property exchange in order to avoid capital gain taxes. Blesener asked if the 6
