MINUTES <br />CITY COUNCIL <br />MAY 9, 2007 <br />issuance of this letter will put the City in liability for relocation costs to <br />the former renter of this property. <br />The City Attorney indicated that the letter is not determinative to the <br />application of relocation costs. The Attorney noted that the former tenant <br />of the property knew that the property owner had the property up for sale. <br />The City Attorney stated that he did not anticipate a claim for relocation <br />costs in this case, and again noted that the 1033 Letter would not be a <br />determinative factor regardless. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2007-5-118 -AUTHORIZING THE CITY <br />ADMINSITRATOR TO ISSUE A 1033 LETTER TO THE FORMER <br />OWNERS OF 91 VIKING DRIVE BASED ON THE DISCUSSION <br />THIS EVENING <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />HAZARDOUS Blesener noted that the City has obtained four quotes for hazardous <br />MATERIALS materials survey for the properties recently acquired by the City at <br />SURVEY - 2250 Rice Street, 85 Viking Drive, and 91 Viking Drive. These quotes <br />2250 RICE range from a low of $2,400 to a high of $3,988. Once the survey is <br />STREET, completed, plans can be made for the demolition of the structures. <br />85 AND 91 It was noted that the McDonalds Restaurant plans to stay open <br />VIKING through the 4`" of July. The City will then coordinate the realignment <br />DRIVE of Viking Drive with the McDonalds redevelopment. <br />Ms. Allan introduced the following resolution and moved its adoption: <br />RESOLUTIONNO. 2007-5-119 -AWARDING THE BID OF <br />LEGEND TECHNICAL SERVICES, INC. IN THE AMOUNT OF <br />$2,400.00 FOR HAZARDOUS BUILDING SURVEY FOR <br />PROPERTIES AT 2250 RICE STREET, 85 VIKING DRIVE, AND 91 <br />VIKING DRIVE <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />JUDGE'S The City Attorney reviewed the Judge's Order relative to the Dayspring <br />ORDER - Development litigation. That Order granted the City's motion to dismiss <br />
