MINUTES <br />CITY COUNCIL <br />NOVEMBER 28, 2007 <br />McGraw stated that he liked the layout of the lots. He noted, however, <br />that this concept has come up quickly, and he would like the opportunity <br />to do the residential platting study prior to action on 565 Little Canada <br />Road. McGraw noted that while he questions the shared driveway <br />situation, individual driveways might not be the best solution for 565 <br />Little Canada Road. <br />Hayes indicated that they would like to close on the property in December <br />so that they can work on the renovation of the existing house over the <br />winter. She indicated that they would then like to proceed with the <br />platting of the property over the next two to three months. Hayes felt that <br />a moratorium on platting decreases the value of the property. Therefore, <br />they would like an exemption so that they can work through their plans for <br />this property. <br />Keis pointed out that the Council is not sure of what it wants relative to <br />the platting of residential properties, and would not be willing to act on a <br />plat of 565 Little Canada Road until the moratorium study is completed. <br />Hayes felt there were three parallel things going on. The first was that an <br />exemption from The moratorium would allow them to own the property; <br />second, is their desire to plat the property over the next 3 to 4 months; <br />and third is their need to renovate the existing house. Hayes indicated that <br />they are willing to work through the issues with the City, but at the same <br />time want to own the property and begin renovations of the existing house. <br />The City Administrator noted that if an exemption from the moratorium is <br />granted, the property owner would be governed by the existing codes and <br />not any new standards that the City might put in place. The risk to the <br />City is that it would not achieve what it is seeking to achieve relative to <br />565 Little Canada Road and code revisions. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2007-11-309 -DENYING THE REQUEST FOR <br />EXEMPTION FROM RESIDENTIAL PLATTING MORATORIUM <br />FOR 565 LITTLE CANADA ROAD GIVEN THE CITY'S NEED FOR <br />TIME TO RE-EVALUATE THE EXISTING ORDINANCE <br />STANDARDS RELATIVE TO SUBDIVISIONS <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />Keis indicated that the City will attempt to complete its study as quickly as <br />possible. <br />22 <br />
