MINUTES <br />CITY COUNCIL <br />FEBRUARY I4, 2007 <br />McGraw asked how the City ensures that the owner is only making the <br />building corrections and is not operating the business. The City <br />Administrator indicated that staff is working with Valor's attorney about <br />putting together an agreement that will indemnify the City while allowing <br />access to the building to make the building corrections. The risk to the <br />City is that someone will be hurt in the building while making these <br />corrections. The Administrator stated that staff will pay attention to what <br />is happening at the site, but monitoring the building to ensure that the <br />business is not being operated will be challenging. <br />The City Attorney reported that the City has done what was needed from a <br />public safety standpoint, and the judge realized it. Valor's presence on the <br />property would be pursuant to the Order to Conect Hazardous Condition <br />of Building. The Attorney stated that the City would like to get a plan <br />from Valor on how the corrections will be made. The City Administrator <br />indicated that if Valor voluntarily complies with the Order, the City will <br />work with them to put a plan in place for correcting the hazards. The <br />Administrator noted that if the building is sold, it will be subject to all the <br />City's zoning requirements. <br />Mr. McGraw introduced the following resolution and moved its adoption: <br />RESOL UTION NO.2007-2-37 -APPROVING THE ORDER TO <br />CORRECT HAZARDOUS CONDITION OF BUILDING PURSUANT <br />TO MINNESOTA STATUTES 463.17 FOR THE VALOR <br />ENTERPRISE PROPERTY AT 3165-3167 SPR UCE STREET AS <br />PRESENTED BY THE CITYATTORNEYANDAUTHORlZING THE <br />MAYOR AND CITYADMINISTRATOR TO EXECUTE THE ORDER <br />ON BEHALF OF THE CITY <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />MANHOLE The City Administrator reviewed the Public Works Superintendent's <br />COVERS February 6, 2007 report recommending the purchase of an additional 200 <br />manhole covers from Fss Brothers at a total cost of $17,572.50. As <br />outlined in the report, the Superintendent indicated that at least 100 of <br />these covers would be used in areas that are susceptible to inflow. Given <br />that the new manhole covers do not have holes in them, they decrease the <br />amount of storm water runoff into the City's sewer system. Additionally, <br />the new covers are much lighter and easier to handle, thus reducing the <br />potential for injury. <br />11 <br />
