MINUTES <br />CITY COUNCIL <br />JUNE 13, 2007 <br />RELEASE The City Administrator reported that MN DOT has acquired drainage <br />OF EASEMENT - easements on the former Levitz property as part of their Unweave The <br />FORMER Weave project. The City is being asked to sign a Release waiving its <br />LEVITZ right to any compensation for the MN DOT easement. This is necessary <br />PROPERTY given that the City has its own easements on this property. The City <br />Administrator described the easements that the City holds, and noted that <br />there is no conflict between these easements and the MN DOT easement. <br />Therefore, it was the Administrator's opinion that the City is not entitled <br />to any portion of the compensation for MN DOT's easement. <br />Mr. McGraw introduced the following resolution and moved its adoption: <br />RESOLUTIONNO. 2007-6-136 -APPROVING THE RELEASE OF <br />CLAIM RELATIVE TO EASEMENTS ON THE FORMER LEVITZ <br />PROPERTYAND AUTHORIZING THE MAYOR AND CITY <br />ADMINISTRATOR TO EXECUTE ON BEHALF OF THE CITY <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />ABATEMENT The City Administrator noted that hazardous materials at 85 and 91 <br />OF Viking Drive, and the former Oasis Station must be abated prior to <br />HAZARDOUS demolition of the structures. Quotations for this abatement work are <br />MATERIALS - due in tomorrow. The City Administrator pointed out that upon award <br />VIKING DRIVE of the bid, ten days notice of the abatement work must be given to the <br />PROJECT State. The Administrator, therefore, requested that the Council either <br />authorize staff to award the low bid, or call for a special meeting this <br />Friday at which the award could be made. <br />Blesener noted that the bid will be awarded to the lowest responsible <br />bidder; therefore, he felt comfortable authorizing staff to make the award. <br />It was noted that the demolition work must be completed as soon as <br />possible to accommodate the relocation of Viking Drive. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2007-6-737-AUTHORIZING THE CITY <br />ADMINISTRATOR TO AWARD THE LOWEST RESPONSIBLE BID <br />FOR ABATEMENT OF HAZARDOUS MATERIALS RELATIVE TO <br />THE VIKING DRIVE IMPROVEMENT PROJECT <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />
