MINUTES <br />CITY COUNCIL <br />JUNE 27, 2007 <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOL UTION NO.2007-6-145 -APPROVING THE REZONING OF <br />3201 COUNTRYDRIVEASREQUESTEDBYHOMFURNITURE <br />FROMBUSINESS-WAREHOUSE (B-W) DISTRICT TO PLANNED <br />UNIT DEVELOPMENT (PUD) AND A PUD PERMIT FOR THE USE <br />OF THE PROPERTYAS PROPOSED SUBJECT TO THE <br />FOLLOWING CONDITIONS: <br />*SUBJECT TO HOM FURNITURE ENTERING INTO A PUD <br />AGREEMENT WITH THE CITY; <br />*THE REZONING IS CONTINGENT UPON THE HOM <br />FURNITURE ENTITY'S PURCHASE OF THE PROPERTY; <br />*ALLOWING FOR INTERIM SIGNAGE AS PROPOSED BY HOM <br />FURNITURE FOR A PERIOD OF ONE YEAR BEGINNING <br />SEPTEMBER I, 2007; <br />*SUBJECT TO TEMPORARY SIGNAGE, SEARCH LIGHTS, TENT <br />AND TRUCKLOAD SALES, AND SEASONAL OUTDOOR <br />DISPLAYS MEETING THE EXISTING CITY CODE <br />REQUIREMENTS; <br />*SUBJECT TO SUBMISSIONAND APPROVAL OFA SITE PLAN <br />INDICATING THE SIZEAND LOCATION OF THE SEASONAL <br />OUTDOOR DISPLAYAREA; <br />*SUBJECT TO THE REQUIREMENT THAT THE ANCHOR <br />TENANT FOR THE PROPERTY OCCUPY A MINIMUM OF 35 % OF <br />THE BUILDING AREA <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />It was noted that at the May 23, 2007 meeting, the City Council approved <br />a Text Amendment relative to permitted uses in the B-W District in <br />response to Hom's proposal for use of this property. Given the rezoning <br />of the property to PUD District, it was the consensus of the Council to <br />rescind the Text Amendment action. <br />Ms. Allan introduced the following resolution and moved its adoption: <br />6 <br />
