MINUTES <br />CITY COUNCIL <br />FEBRUARY 14, 2007 <br />Keis introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2007-2-35 -APPROVING THE CANADIAN <br />WOODS PARK CHARGE CONCEPT AS OUTLINED BY THE CITY <br />ADMINISTRATOR IN HIS LETTER DATED JANUARY 26, 2007 <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />McDONALD'S The City Administrator presented a site plan and reviewed the parcel <br />PROPERTY exchanges involved in the redevelopment of the McDonald's, which <br />EXCHANGE also involves the City's acquisition of the Oasis site and the realignment of <br />Viking Drive. The Administrator noted that after the property exchanges <br />are complete, the City will be left with a parcel that consists of <br />approximately one acre that can be sold. <br />The City Administrator then reviewed in detail his report dated February <br />9, 2007 relative to the proposed Real Estate Swap Contract with <br />McDonald's. He highlighted the conditions included in the Swap Contract <br />noting a 20-Year Use Restriction on Parcel C stating it cannot be sold for a <br />restaurant development and Parcels E and F cannot be sold for restaurant <br />development serving hamburgers. Parcel C will be utilized as the <br />realigned Viking Drive right-of-way. Parcels E and F make up the one <br />acre parcel that could be sold for redevelopment. The Administrator felt <br />these use restrictions were acceptable. <br />The Administrator presented a concept layout plan for the redeveloped <br />McDonald's noting the two access points on Minnesota Avenue. While <br />the layout plan is not yet in final form, the concept presented would meet <br />City Code requirements based on the City Planner's review of this <br />concept. The Administrator indicated that the functionality of the <br />realigned Viking Drive and Minnesota Avenue will be somewhat <br />challenging, but will be an improvement over the current situation. <br />The City Administrator indicated that it has been recommended that the <br />entire area be replatted as part of the property exchange. McDonald's has <br />agreed to pay its prorated share of platting costs. The City Engineer has <br />estimated the cost of platting this area at $20,000. <br />The Administrator reported that there are some contingencies in the <br />McDonald's swap agreement that pose a slight risk to the City given the <br />timing for closing on the Oasis property and the two Viking Drive sites. <br />McDonald's could back out of the deal if there is contamination on the <br />
