MINUTES <br />CITY COUNCIL <br />FEBRUARY 14, 2007 <br />• Trail placement would be restricted to a minimum of 50 feet from <br />the majority of Maplewood property lines and 35 feet from the <br />Ostertag and Mogren properties; <br />The easement language will be such that once the trail is <br />constructed, the easement will be limited to a width of 30 feet (15 <br />feet on either side of the centerline of the trail). It is anticipated <br />that the trail will meander through this property given the <br />meandering wetland edges. Therefore, the blanket easement at this <br />time with further refinement once the trail is constructed provides <br />the City with some flexibility when determining hail placement at <br />some time in the future. <br />The trail would be located in such a way as to minimize the need <br />for bog walks, thus minimizing the City's construction costs. It <br />should be noted, however, that there will be a minimum of 200 feet <br />of bog walk needed on the south end. The City would also work <br />with the Watershed on setback from the edge of the wetland, <br />noting that while the Watershed would prefer a 37.5 foot buffer, <br />they have agreed to work with the City to nail•ow this distance <br />depending on specific circumstances. <br />Easement dedication will still require the payment of a cash park <br />charge on each individual lot developed. <br />Pat Johnson, developer of Canadian Woods, indicated that this park charge <br />was acceptable to him and would work for the Maplewood property <br />owners that he plans to sell the property to. <br />Allan felt the blanket easement option was a good one, and noted that the <br />City could improve the trail at some time in the future. McGraw asked if <br />there would be assurance for the City that the property would be kept in a <br />natural state. The City Administrator indicated that a deed restriction <br />would be placed on the property that would ensure it is left in a natural <br />state even when the property is sold from one owner to another. Blesener <br />indicated that this deed restriction would have to be in place before <br />Johnson sells the property to the Maplewood residents. The Administrator <br />noted that this would prevent the consh•uction of garages or sheds on the <br />property as well as tree removal. <br />The Administrator also indicated that once a trail is constructed, the City <br />would be willing to post no trespassing signs along the trail to keep people <br />from wondering off the trail easement onto private property. <br />6 <br />
