The accessory shed <br />on Parcel A is located 7.5 feet from the side lot line abutting Boss Road. A portion of <br />the Boss Road right-of-way has previously been vacated to accommodate this structure. <br />Access. As existing, access to Parcel A is off Bryan Street. No alterations will be <br />made to this condition. Access to Parcel B will be established by construction a portion <br />of Boss Road, which runs along the east side of the property. Boss Road is an existing <br />right-of-way that is currently not being used by the City. <br />The City requires a minimum right-of-way width of 50 feet for single family residential <br />local streets platted and/or dedicated after October 1, 1981. A small portion of the right- <br />of-way on the east side has been previously vacated. The remaining width of the right- <br />of-way is 50 feet, satisfying the minimum requirement. The applicant has previously <br />worked with the City to establish construction standards for Boss Road. The applicant <br />shall be required to comply with these standards upon construction. <br />A driveway 35 feet in width is proposed for Parcel B in the southwest corner of the <br />property, approximately two feet from the side lot line. The Ordinance requires that all <br />curb cuts be located a minimum of five feet from side lot lines. The Ordinance also <br />limits curb-cut accesses to a maximum width of 24 feet. The applicant shall be required <br />to shift the driveway to the north to meet the five foot minimum setback, and reduce the <br />width of the driveway at the curb cut to not exceed 24 feet. <br />RECOMMENDATION <br />The proposed lot split results in two parcels that are generally consistent with the <br />regulations of both the Zoning Ordinance and the Subdivision Ordinance. Both lots <br />meet all lot requirements and setback requirements. However, an alternate driveway <br />design must be submitted for Parcel B. As proposed, this driveway does not meet the <br />setback or curb cut requirements. As such, staff recommends approval of the simple <br />subdivision as proposed, subject to the following conditions: <br />1. The driveway on Parcel B shall be modified to meet the five foot side yard <br />setback requirement and the 24 foot maximum curb cut requirement. <br />2 <br />
