MINUTES <br />PLANNING COMMISSION <br />FEBRUARY 8, 2007 <br />stationsh•estaurants/etc. on the Little Canada Road/35E intersection. Dehn <br />stated that the high rise pylon serves a purpose, and they would like to <br />update that sign as well. Improvements to the high rise pylon as well as <br />other improvements to the site are being contemplated for this spring. Dehn <br />was concerned that the City would require the high rise pylon be removed. <br />Duray stated that his position would be to let the high rise pylon remain for <br />a period of time, and suggested that the face of that sign be upgraded. Dehn <br />indicated that they would be willing to change out the face, but was <br />concerned about making the investment if the City is going to require the <br />pylon be removed. <br />Duray asked about the rezoning proposal. The City Planner indicated that <br />the property is currently zoned General Business, B-3. He indicated that <br />since the Sinclair Station was established, the B-3 Zoning Code was <br />amended and gas stations/convenience stores were eliminated from the B-3 <br />Zoning District. Therefore, a rezoning to either Auto-Oriented Business <br />District (B-2) or Comprehensive Business District (B-4) is proposed to <br />bring the use of the property into compliance. The Planner noted that both <br />districts allow gas station convenience stores by CUP. The B-4 District, <br />however, allows a wider variety of commercial uses. Therefore, if the site <br />were to redevelop at some time in the future, the B-4 Zoning would ensure <br />that the property zoning was in place. It was noted that the Citgo property <br />is zoned B-2. The Planner felt B-4 zoning was more appropriate for the <br />Sinclair property given the surrounding commercial uses. <br />Duray asked about the Conditional Use Permit action before the Planning <br />Commission. The Planner indicated that the former Conditional Use Permit <br />for this property lapsed when the Sinclair Station was closed for a period of <br />time. The CUP before the Commission is to re-establish the CUP for a gas <br />station/convenience store. The Planner also noted that the applicant is <br />anticipating additional site improvements, and indicated that the sixteen <br />(16) conditions that he outlined in his February 2, 2007 report should be <br />addressed at the time these additional improvements are made. <br />Duray asked if there would be auto repair done at the station. Dehn replied <br />that there would be no auto repair. Duray asked if the parking area is <br />appropriately designated. Dehn replied that it is and noted that there are the <br />appropriate handicapped parking spaces and that the sidewalk in front of the <br />building is handicapped accessible. The parking lot does need some <br />improvements, and Dehn anticipated that these improvements will be done <br />in the spring and summer. Dehn noted that he purchased the property on <br />December 1, 2006. In addition to parking lot improvements, Dehn <br />indicated that he has other image improvements planned. <br />-3- <br />
