MINUTES <br />CITY COUNCIL <br />APRIL 23, 2008 <br />deposit. The consensus of the Council was to not waive the escrow <br />deposit. <br />There was no one present from the general public wishing to comment on <br />this matter. <br />Upon motion by Allan, seconded by Keis, the public hearing was closed. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2008-4-108 - APPROVING A PLANNED UNIT <br />DEVELOPMENT PERMIT TO ALLOW AN INTERIM USE OF <br />COMMERCIAL PROPERTY FOR A PRIVATE AUTO REPAIR <br />HOBBYIST AT 2968 RICE STREET AS REQUESTED BY MARILYN <br />MONTREA U SUBJECT TO THE SAME CONDITIONS THAT WERE <br />IMPOSED WITH THE 2007 PUD PERMIT WHICHARE AS <br />FOLLOWS: <br />o COMPLIANCE WITH THE CONDITIONS OUTLINED <br />IN THE CITY PLANNER'S REPORT DATED <br />FEBRUARY2, 2007; <br />o SUBJECT TO THE INTERIM USE PERMIT NOT <br />BEING ABLE TO BE ASSIGNED TO ANOTHER <br />TENANT OR OWNER OF THE PROPPRTY; <br />o SUBJECT TO AN INSPECTION OF THE <br />GARAGE/WAREHOUSEBUILDING BYTHE CITY'S <br />FIRE MARSHAL; <br />o SUBJECT TO THERE BEING NO OUTDOOR <br />STORAGE, JUNK, OR DEBRIS ON THE SITE; <br />AND THAT THERE BE NO SALE OF VEHICLES FROM THIS <br />PROPERTY, WITH THE PERMIT TO RUN FOR ONE YEAR FROM <br />THE DATE OF THIS EVENING'S APPROVAL OR UNTIL THE <br />SALE OF THE PROPERTY, WHICHEVER COMES FIRST <br />The foregoing resolution was duly seconded by Allan. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />PRELIMINARY Mayor Blesener opened the Public Hearing to consider approval of a <br />AND FINAL Preliminary and Final Plat for the Melancon Plat, property owned by the <br />PLAT - City and located at Rice Street and Viking Drive. <br />MELANCON <br />PLAT - The City Planner reported that the plat is necessary due to the re-alignment <br />RICE STREET/ of Viking Drive. He noted that two of the three of the lots included in the <br />VIHING DRIVE plat are owned by the City of Little Canada. <br />15 <br />
