MINUTES <br />CITY COUNCIL <br />APRIL 23, 2008 <br />RECESS <br />PUD FOR <br />INTERIM <br />USE <br />PERMIT - <br />2968 RICE <br />STREET - <br />TROBEC/ <br />MONTREAU <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO.2008-4-108 -LIFTING THE MORATORIUM ON <br />THELIGHT-INDUSTRIAL (I-I) DISTRICT UPON PUBLICATION <br />OF THE REVISED I-1 DISTRICT STANDARDS <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />At this point in the meeting, 9:31 p.m., the Council took a brief recess. <br />The meeting was reconvened at 9:41 p.m. <br />Mayor Blesener opened the public hearing to consider a Planned Unit <br />Development Permit to allow an interim use of commercial property for a <br />private auto repair hobbyist at 2968 Rice Street as requested by Marilyn <br />Montreau. It was noted that the City Planner and the Planning <br />Commission have recommended approval subject to conditions. <br />The City Planner indicated that an interim use was approved for this <br />property in 2007, and that permit has expired. The applicant currently has <br />the property for sale and is requesting that the interim use be allowed to <br />continue on the property. <br />Blesener noted the recommendation of the Planning Commission that <br />there be no vehicle sales from this property. Blesener indicated that he <br />drove by the site and it appears that the vehicle sales are on the adjacent <br />property, not this one. Blesener also noted that the property has been <br />cleaned up and he is convinced in speaking with the operator that it is not <br />a commercial business but merely a private auto repair hobby being <br />operated from 2968 Rice Street. <br />McGraw noted that there is a snow plow part being stored outside behind <br />the garage. Other than that, the property was clean. <br />Blesener noted the 2007 approval of the interim use in which the City <br />stated that there would be no renewal of the permit. Allan noted that the <br />property is up for sale and suggested that renewal would be acceptable for <br />one year or until the property is sold, whichever occurs soonest. <br />The Council discussed the applicant's request to waive the fee associated <br />with this interim use permit. It was noted that the fee is an escrow deposit <br />to cover processing costs. Once costs are covered, if there is any balance <br />remaining it will be refunded to the applicant, as was the case in the 2007 <br />14 <br />
