selected by the City. For the purposes of this Section, such a determination of the value of the <br />undeveloped land shall be conclusive. Any costs incurred by the City in determining the fair market <br />value shall be paid by the developer. The City Council may use purchase agreements and current <br />market value appraisals to determine value. <br />2101.040. RESUBDIVISION CREDIT. In the development of any parcel of land which <br />previously has been subdivided and previously subjected to a cash donation pursuant to this Chapter, <br />the amount of such cash donation previously received shall be a credit against any new donation <br />required for resubdivision. <br />2101.050. PARK CHARGE FOR INDIVIDUAL DWELLINGS. <br />1. Recognizing that additional residential dwellings not part of a subdivision, also create <br />a need for public parks, the Council declares that this Chapter shall also apply to single family <br />dwellings and multiple dwellings to be constructed, providing that such dwellings are not located in <br />a subdivision which has already been subjected to the park charge pursuant to the provisions of this <br />Chapter. <br />2. Every applicant for a building permit for a single family dwelling shall, at the time of <br />submitting such application, pay to the City the sum of Six Hundred Twenty-five and No/100 Dollars <br />($625.00), which money shall be placed in a special fund as hereinafter provided. Every applicant <br />for a building permit for a two family dwelling shall, at the time of submitting such application, pay <br />to the City the sum of One Thousand Two Hundred Fifty and No/100 Dollars ($1,250.00), which <br />money shall be placed in a special fund as hereinafter provided. Applicants for permits for <br />remodeling or for home additions shall be exempt from this provision. <br />3. Every applicant for a building permit for a multiple dwelling shall, at the time of <br />submitting such application, pay the sum of Three Hundred Twelve and 50/100 Dollars ($312.50) for <br />each dwelling unit located in such multiple dwelling building. <br />4. Apartment units coverted to condominiums shall be subject to a park charge ofThree <br />Hundred Twelve and 50/100 Dollars ($312.50) at the time of the conversion, except that no charge <br />shall be made if any park charges were previously paid at the time of the original subdivision or <br />development. All such charges shall be payable at the time application for conversion is made. All <br />conversions are subject to Council approval. Any rental units converted to condominiums on or after <br />November 28, 1979, shall be subject to the park charge unless a park charge has already been paid. It <br />is intended that this subsection be in accord with Council Resolution 79-11-537. <br />2101.060. SPECIAL FUND. Cash donations received pursuant to the provisions of this <br />Chapter shall be held in a special fund and used only for the purposes of land acquisition, land <br />development and capital outlay for parks, playgrounds, public open space, storm water holding pond <br />areas and debt retirement in connection with land previously acquired for such public purposes. <br />2101-2 <br />
