MINUTES <br />CITY COUNCIL <br />MARCH 26, 2008 <br />Holm also noted that the verbal assurances did not come from the City <br />Adminisriā¢ator or the City Council. <br />Blesener asked when the permit was issued. Holm replied that it is a <br />three-year permit which was last renewed in 2005. <br />Blesener noted that On-Site is the only portable toilet company in the <br />Metro area that does not utilize the Met Council dump sites. Holm <br />indicated that there are other companies in other counties utilizing other <br />disposal methods. Holm stated that he does not feel he has an unfair <br />advantage over other portable toilet companies just because he did his due <br />diligence at the time he purchased his property. <br />Blesener noted that it is not in the best interests of the City to continue the <br />current practice. The permit is in effect until May 31, 2008 and the City <br />staff recommendation is to not renew the permit. Blesener noted that <br />while Mr. Holm's claims he did not receive the notice of the February 27, <br />2008 hearing, he was given an opportunity to present his case this evening. <br />The City Administrator asked Holm what his trade area is. Holm replied <br />that it is the Metro area. The Administrator pointed out that since trucks <br />are servicing areas throughout the Metro, routes could be developed so <br />that the trucks can dump at the various Met Council dump sites before <br />returning to the shop. Holm agreed that this could be done, and pointed <br />out that he estimated his added expense for dumping at Met Council sites <br />based on his current practices. <br />Keis pointed out the sewer back-up loss from this line that the City had to <br />pay for with taxpayers' dollars. He also pointed out the recommendation <br />of the League of Minnesota Cities Insurance Trust against the renewal of <br />this license. Keis further noted that the Met Council has indicated that <br />while they would honor the permit if the City chose to renew it, they <br />would not issue this type of permit otherwise. <br />McGraw indicated that the League has advised the City that it would not <br />be wise to renew the permit. Also, the Met Council has been trying to get <br />a handle on this type of disposal and would not issue a similar permit. <br />McGraw felt it would be unwise for the City to go against the advice of <br />the League and the Met Council. <br />Holm pointed out that the Met Council indicated that they would not <br />object to the renewal of his permit. Blesener agreed that the Met Council <br />indicated they would honor the permit, but also indicated that they would <br />not issue a new permit similar to this one. <br />12 <br />
