A Development Agreement has been drafted by the City and shall be executed by the <br />developer. <br />Title Commitment <br />The City Attorney reviewed the title commitment and final plat and notes consent to plat <br />documents will be required by the mortgage companies. <br />Stormwater Maintenance Agreement <br />A Maintenance Agreement for Stormwater Management Facilities has been drafted and shall be <br />executed. <br />Earth Moving/Borrow Pit Conditional Use Permit <br />In September 2015, the Council approved with Res. No. 15-91 a conditional use permit for <br />earth moving/borrow pit for Jeff Morell. The borrow pit was to be utilized during the <br />development of Century Farm North 6th Addition. It is staff's understanding the borrow pit <br />will no longer be used for this development. <br />RECOMMENDATION <br />The Planning & Zoning Board reviewed the PUD Final Plan/Final Plat on March 11, 2015. The <br />Board and staff recommend approval of the following items with conditions as listed: <br />1. Resolution No. 16-43 Approving PUD Final Plan/Final Plat <br />2. Resolution No. 16-44 Approving Development Agreement <br />3. Resolution No. 16-45 Approving Maintenance Agreement for Stormwater Management <br />Facilities <br />ATTACHMENTS <br />1.
