CITY OF LINO LAKES <br />RESOLUTION NO. 16-55 <br />RESOLUTION AUTHORIZING ACQUISITION OF PERMANENT EASEMENT <br />OLD BIRCH STREET CUL DE SAC <br />WHEREAS, pursuant to Resolution No. 16-13, adopted the 11th day of April, 2016, the City <br />Council approved the Development Agreement for Saddle Club 2nd Addition; and <br />WHEREAS, said agreement provided for the construction of a cul de sac at the northern <br />terminus of Old Birch Street; and <br />WHEREAS, the City of Lino Lakes, a Minnesota municipal corporation, acting by and <br />through the City Council, is authorized by law to acquire real estate which is needed for public <br />use or purpose; and <br />WHEREAS, the WSB and Associates, on behalf of the City have reached a settlement on the <br />purchase price of the easement; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />LINO LAKES, MINNESOTA: <br />That the acquisition of a permanent drainage, utility and roadway easement, as described in <br />Exhibit A, is hereby approved in the amount of $3,000. <br />Adopted by the Council of the City of Lino Lakes this 13th day of June, 2016. <br />The motion for the adoption of the foregoing resolution was introduced by Council Member <br />Rafferty and was duly seconded by Council Member Maher and <br />upon vote being taken thereon, the followizf� voted in favor thereof. <br />Ratferty, Maher, Man ey, Mrs erman, Reiner <br />The following voted against same: <br />none <br />ATTEST: <br />Whereupon said resolution was declared duly passed and adopted. <br />
