28 <br />4. Operating and Maintenance Requirements for PUD Common Open <br />Space/Facilities. <br /> <br />A homeowners association shall be created and Declaration of Covenants and <br />Conditions shall be recorded against the property at the time of final plat. Public park <br />land and trail corridors will be deeded to the City. Drainage & utility easements and <br />conservation easements will be dedicated to the City and RCWD. <br /> <br />5. Utilities. <br /> <br />All single family and townhome utilities will be installed underground. Separate public <br />utilities are provided to each single family and townhome unit. <br /> <br />6. Roadways, Private. <br /> <br />Private roadways within the townhome neighborhood shall have an improved surface of <br />26-28 feet in width and shall be so designed as to permit the City fire trucks to provide <br />protection to each building. <br /> <br />No portion of the required private road system is used in calculating required off-street <br />parking space or be used for parking. <br /> <br />7. Development Agreement. <br /> <br />Development Agreements detailing developer responsibilities and securities will be <br />executed with each final plat. <br /> <br />(d) The proposed use can be accommodated with existing public services and <br />will not overburden the City’s service capacity. <br /> <br />The proposed Watermark development can be accommodated with existing public <br />services and will not overburden the City’s service capacity. The site is ultimately served <br />by MCES Interceptor 76-51 that is adequately sized for the development in the district. <br />The existing water supply and water distribution system can provide adequate water <br />volume and fire protection. <br /> <br />Section 1007.024 PUD, Planned Unit Development <br /> <br />Per Section 1007.024(1) Purpose and Intent, the PUD, by allowing deviation from the <br />strict provisions of this Ordinance related to setbacks, heights, lot area, width and depths, <br />yards, etc., by conditional use permit or a mixture of uses by rezoning to a PUD District, <br />is intended to encourage: <br /> <br />(a) A development pattern in harmony with the objectives of the <br />Comprehensive Plan. <br />
