COUNCIL MINUTES July 25, 2016 <br />DRAFT <br />4 <br /> 136 <br />Julie Eddington added, regarding tax increment legislation, that there is a recommendation that the 137 <br />pooling limit be considered on an annual basis only but that was not approved by the legislature; it may 138 <br />be coming up soon at a special session however. The mayor asked if one hundred percent of the 139 <br />increment could be granted to the project if that was desired by the city and Ms. Eddington concurred 140 <br />that the twenty percent for pooling is flexible for either project or city (project related). Pooled funds 141 <br />that aren’t used go into redistribution to all the impacted taxing districts. 142 <br /> 143 <br />The mayor noted that the council discussed postponing some actions at the work session; the public 144 <br />hearing has been advertised however and will be opened. 145 <br /> 146 <br />Mayor Reinert opened the public hearing. There being no one present wishing to speak, the public 147 <br />hearing was closed. 148 <br /> 149 <br />Regarding Resolution 16-75, Council Member Kusterman moved to approve the resolution as presented. 150 <br />Council Member Manthey seconded the motion. It was clarified that the council maintains the right to 151 <br />decertify the district prior to fully authorized period. Council Member Kusterman commended staff on a 152 <br />good presentation/explanation and he clearly sees that “but-for” this tax increment plan, the proposed 153 <br />development wouldn’t occur here in the City so it makes sense to bring this business into Lino Lakes. 154 <br />Mayor Reinert concurred that “but-for” the development occuring, the additional tax base wouldn’t be 155 <br />created. The mayor noted the presence of the Target/Kohl’s development in the city that utilized a 156 <br />similar financing plan. Council Member Kusterman noted that there are no negative comments being 157 <br />received through the public hearing process. Council Member Rafferty also commended staff on the 158 <br />presentation clarifying the finer points of the request. 159 <br /> 160 <br /> Motion carried on a voice vote. 161 <br /> 162 <br />ii. Consider Resolution No. 16-76, Approving Development Stage Plan and Preliminary Plat, 165 <br />Clearwater Creek Business Park 166 <br /> 167 <br />Community Development Director Grochala introduced Kendra Lindahl, Landform, who has been 168 <br />assisting the city on this project. Ms. Lindahl reviewed a PowerPoint presentation providing information 169 <br />on the proposed project: 170 <br />- Rezoning of property; 171 <br />- What currently exists on the property; 172 <br />- The existing AUAR (the proposal is consistent); 173 <br />- A review of the preliminary plat; 174 <br />- Transportation plans included in the project, including developer responsibilities; 175 <br />- The site plan including access points, floodplain and wetland impacts and mitigation plans 176 <br />(currently under review by the Rice Creek Watershed District); 177 <br />- The request to consider outside storage is not allowed; 178 <br />- A view of proposed screening and landscaping for the project; 179 <br />- A view of elevations and location of mechanicals; 180
