COUNCIL MEETING JANUARY 22, 1996 <br />and the road was to be fully reconstructed to MSA standards and MSA funds were to be <br />used. Mr. Corson said that was the original understanding and if there is something else, <br />he would like to find out where this agreement is coming from. He said that the original <br />developers agreement did address a lot of the issues just raised. <br />Council Member Lyden asked Mr. Corson for the date of the original developers <br />agreement. Mr. Corson said it is dated July, 1995. Mayor Landers noted that Council <br />Member Lyden said original developers agreement and asked if there has been another <br />agreement since then. Mr. Corson said no, the agreement has numbers and on the back <br />page several items are discussed. He said that Hokanson's understanding of the situation <br />comes from the developers agreement, copies of the Council minutes, video tapes and the <br />discussions with staff. <br />Mr. Ahrens clarified dates by saying that the developers agreement is dated July, 1995, <br />the traffic analysis was completed in October, 1994 and the feasibility report was <br />completed in December, 1995. <br />Dawn Kenny, 6299 Red Maple Lane - Ms. Kenny said she did not visit the 12th <br />Avenue/Holly Drive area of the City very much but wanted to speak about another <br />development that affects her as a resident. She noted that Ware Road was considered a <br />hazardous road even before Fox Trace and Pine Ridge developments were constructed. <br />Now she considers it a deadly road. Ms. Kenny said that when citizens on Ware Road <br />wanted to upgrade the road because it was a MSA road, the City said no because the <br />property owners abutting the road would not accept assessments. Now she hears all this <br />"stuff' about Holly Drive and to her it sounds like de ja vu. Ms. Kenny said that she did <br />not know if there were traffic studies on Ware Road but there were studies, the estimate <br />of traffic should have been doubled because it is a dangerous road. She said that she did <br />not think that the condition of Ware Road was the fault or the responsibility of the <br />original citizens to upgrade the road now. Ms. Kenny said she thought Ware Road should <br />have been upgraded first to handle the increase in traffic. She said that it sounds like the <br />same thing is happening on 12th/Holly and advised the City Council to "tread softly" <br />because they could be creating the same situation that they have on Ware Road. <br />Council Member Kuether moved to close the public hearing at 7:40 P.M. Council <br />Member Neal seconded the motion. <br />Council Member Lyden said considering the 20/20 project and the real issue that was <br />brought up by the 20/20 project about increasing the communication between the <br />Council, staff and the public, the Council would be doing the right thing by keeping the <br />public hearing open. Mayor Landers said he agreed with Council Member Lyden and <br />would favor keeping the public hearing open until all the facts have been presented by <br />Ms. Wyland, Mr. Brixius and others. He suggested that the public hearing be continued, <br />compile all of the information and then discuss the matter at the next work session and <br />then when all questions have been answered, the public hearing can be closed at the next <br />City Council meeting. <br />PAGE 15 <br />
