A proposed middle school, an industrial building at I35E and expansion <br />at the Minnesota Correctional Facility are all proposed for construction in 1996. <br />Mr. Kluegel presented a graph of building activity in Lino Lakes beginning in 1988 and <br />noted that residential building has stabilized near 200 new homes per year. He anticipates <br />this trend to continue. <br />Council Member Bergeson noted that all the institutional construction is exempt and not <br />taxed. <br />Council Member Kuether moved to accept the 1995 Building Officials Report. Council <br />Member Neal seconded the motion. Motion carried unanimously. <br />CONSIDERATION OF RESOLUTION NO. 96 - 09 AMENDING THE <br />CENTENNIAL FIRE DISTRICT JOINT POWERS AGREEMENT, II, FIRE <br />CHIEF MILO BENNETT <br />Chief Bennett proposed a resolution to modify the Joint Powers Agreement that governs <br />the Centennial Fire District. He explained that the Centennial Fire District operates under <br />a Joint Powers Agreement between the cities of Lino Lakes, Circle Pines and Centerville. <br />A Steering Committee consisting of two (2) members from each city oversee the <br />operation of the Fire District. The proposed modification will have to be approved by all <br />three (3) cities. Chief Bennett said this would be done in the very near future. <br />The proposed changes to the Joint Powers Agreement include Section 2.5, Quorum and <br />deletion of Sections 7.2, 7.3 and 7.4 which describes the Balancing Formula. Section 2.5 <br />requires five (5) of the six (6) regular committee members to be present for a quorum to <br />conduct business. Resolution No. 96 - 09 changes this provision tso that four (4) of six <br />(6) committee members be present with the addition that each municipality must be <br />represented at the meeting. Chief Bennett explained that there have been instances when <br />the Steering Committee was unable to conduct business because of a lack of quorum. <br />The second modification involves deleting Sections 7.2, 7.3 and 7.4 which defines the <br />balancing formula that affects the funding from each of the cities. The main formula sets <br />up funding requirements based on the five (5) year average of "runs" for a city, the <br />population and the market value which all represents the actual history, the people and <br />the property which the Fire District protects. In addition, there is a balancing formula <br />that attempts to make sure that a home in one city pays about the same in property taxes <br />as a similar home in the other two (2) cities. Chief Bennett would like to remove this <br />section since it does not insure this equity. He outlined the formula for funding noting it <br />is unpredictable and throws the formula out of balance. In fact, the formula does the <br />opposite of what it is intended to do. The formula has been used for the past five (5) <br />years and during four (4) of these years there has been a balancing adjustment paid back <br />and forth between the cities.
