I would recommend that we set out a specific paragraph to deal <br />vvith insurance end:pdemnification. I would recommend that the following paragraph <br />be inserted in that location: <br />"The parties shall obtain and maintain workers' compensation insurance, <br />automobile insurance for vehicles and general liability insurance for bodily <br />injury, personal injury and property damage to their respective officials <br />and employees in the performance of duties arising under this agreement, <br />and provide certification and evidence of such coverage to the other <br />party. Each party hereto shall fully indemnify and hold harmless the <br />other party against all claims, losses, damage, liability, suits, judgments, <br />costs and expenses by reason of action or inaction of its employees <br />assigned to work in the recreation programs. This agreement to <br />indemnify and hold harmless does not constitute a waiver by any <br />member of limitations on liability provided by Minnesota Statute, Chapter <br />466." <br />If you have any other questions, please contact me. <br />ely, <br />illiam G.
