I would recommend that we set out a specific paragraph to deal
vvith insurance end:pdemnification. I would recommend that the following paragraph
be inserted in that location:
"The parties shall obtain and maintain workers' compensation insurance,
automobile insurance for vehicles and general liability insurance for bodily
injury, personal injury and property damage to their respective officials
and employees in the performance of duties arising under this agreement,
and provide certification and evidence of such coverage to the other
party. Each party hereto shall fully indemnify and hold harmless the
other party against all claims, losses, damage, liability, suits, judgments,
costs and expenses by reason of action or inaction of its employees
assigned to work in the recreation programs. This agreement to
indemnify and hold harmless does not constitute a waiver by any
member of limitations on liability provided by Minnesota Statute, Chapter
466."
If you have any other questions, please contact me.
ely,
illiam G.
