COUNCIL MEETING NOVEMBER 27, 1995 <br />Conditions of approval for this preliminary plat included the provision of landscaping <br />along Lilac Street, protective covenants acknowledging the air -park proximity, the <br />accessory building size for the air -park lots and a north orientation for the homes to be <br />constructed on Lots 17, 18 and 19, Block 5. These conditions have been met and a copy <br />of the landscape plan, which has been reviewed by the City Forester, was included in the <br />Council packets for Council review this evening. <br />A Development Agreement has been signed and financial guarantees posted. The City <br />Attorney has indicated that some changes must be completed before he will approve the <br />title commitment. City Staff is recommending that Phase I, Behm's Century Farms be <br />approved subject to the condition that the title commitment be reviewed and approved by <br />the City Attorney prior to release of the final plat document. <br />Council Member Bergeson asked what was the status of the east portion of Thomas <br />Street. Ms. Wyland explained that a utility easement will provide access for future sewer <br />and water utilities can be extended east on Thomas Street to serve the resident on that <br />street. Ms. Wyland referred to the restrictive covenants that will be placed on the entire <br />Behm's Century Farm subdivision and noted that item No. 8 should be modified to delete <br />the following; the hangars are for the exclusive use of the property owner for the storage <br />of airplanes. This condition was modified during the review of the preliminary plat but <br />was incorrectly noted in those Council minutes. To avoid future problems, this should be <br />corrected now by a Council motion. <br />Mr. Schumacher asked if the trail issue has been resolved. He noted that there was talk <br />about a future plat coming before the City Council and that a connecting trail would be a <br />part of the future plat. Ms. Wyland explained the intent of the developer and the hope of <br />the Park Board is that a trail will be provided to access a park to the west of the <br />subdivision. Since the trail is to be located in a future development phase and Rice Creek <br />Watershed District (RCWD) permits have not been finalized, the developer received <br />communication from RCWD that this trail alignment is very feasible. The developer has <br />provided a letter to the City stating that if the trail cannot be constructed as desired by the <br />Park Board, additional park land will be dedicated from Phase IT or Phase 111 to satisfy the <br />Park Board request <br />The developers engineer has had several meetings with RCWD regarding the trail <br />alignment. <br />Mr. Uhde, G. M. Development, responding to a question from Mayor Reinert, explained <br />that construction of the first phase of 55 lots will start in March or April of 1996. He <br />expects that about 25 or 30 homes will be constructed per year which would mean that the <br />lot inventory will be sufficient until mid-1997. The second phase will be started probably <br />in the fall of 1997 with construction actually beginning in the spring of 1998. It will take <br />about four (4) years to complete the entire development. <br />Page 7 <br />
