8. Within three working days after receipt of a test result from the <br />testing laboratory, the employee or job applicant shall be informed <br />in writing of a negative test result on an initial screening test or of <br />a negative or positive result on a confirmatory test and the right <br />provided in paragraph J of this section. In the case of the positive <br />test result on a confirmatory test, the employee or job applicant <br />shall also be informed in writing of the rights provided in <br />paragraphs I and K of this section. <br />9. Within three working days after a notice of a positive test result on <br />a confirmatory test, the employee or job applicant may submit <br />information, in addition to any information already submitted on <br />the Alcohol and Drug Testing Notification Form, to explain the <br />test result. <br />10. An employee or job applicant has the right to request and receive a <br />copy of the test result report on any drug and alcohol test. <br />11. An employee or job applicant may request a confirmatory retest of <br />the original sample at the employee's or job applicant's own <br />expense after notice of a positive test result on a confirmatory test. <br />Within five working days after notice of the confirmatory test <br />result, the employee or job applicant shall notify the City in writing <br />addressed to the attention of the City Manager, of the employee's <br />or job applicant's intention to obtain a confirmatory retest, or it is <br />deemed waived. Within three working days after receipt of the <br />notice, the City shall notify the original testing laboratory that the <br />employee or job applicant has requested the laboratory to conduct a <br />confirmatory retest or transfer the sample to another laboratory <br />licensed by the Minnesota Department of Health to conduct a <br />confirmatory retest. The original testing laboratory shall insure <br />that the chain of custody procedures are followed during transfer of <br />the sample to the other laboratory. The confirmatory retest must <br />use the same drug or alcohol threshold detention levels as used in <br />the original confirmatory test. If the confirmatory retest does not <br />confirm the original positive test result, no adverse personnel <br />action based on the original confirmatory test will be taken against <br />the employee or job applicant. <br />K. Discipline or Discharge <br />1. On the basis of one positive test result on a confirmatory test, the <br />employee may be disciplined.
