Anoka County Contract/1960079 <br />AGREEMENT FOR MULTI -UNIT RESIDENTIAL RECYCLING PROGRAM <br />THIS AGREEMENT made and effective as of the 18th day of July, 1995, notwithstanding the date of the <br />signatures of the parties, between the COUNTY OF ANOKA, State of Minnesota, hereinafter referred to as <br />the "COUNTY", and the City of Lino Lakes hereinafter referred to as the "MUNICIPALITY". <br />WITNESSETH: <br />WHEREAS, Anoka County has allocated $96,000 from landfill surcharge revenue for multi -unit <br />residential recycling programs; and <br />WHEREAS, Landfill abatement is an authorized use of these monies; and <br />WHEREAS, the County wishes to assist the Municipality in meeting recycling goals established by the <br />Anoka County Board of Commissioners by providing funds to cities and townships in the County for multi- <br />unit residential recycling programs. <br />NOW, THEREFORE, in consideration of the mutual covenants and promises contained in this <br />Agreement, the parties mutually agree to the following terms and conditions: <br />1. PURPOSE. The purpose of this Agreement is to provide for cooperation between the County and the <br />Municipality to implement multi -unit residential recycling programs in the Municipality. <br />2. TERM. The term of this Agreement is from July 18, 1995 through December 31, 1996, unless <br />earlier terminated as provided herein. <br />3. DEFINITIONS. The following definitions shall apply to this agreement: <br />A. "Recycling" means the process of collecting and preparing recyclable materials and reusing the <br />materials in their original form or using them in manufacturing processes that do not cause the <br />destruction of recyclable materials in a manner that precludes further use. <br />B. "Recyclable materials" means materials that are separated from mixed municipal solid waste for <br />the purpose of recycling, including paper, glass, plastics, metals, fluorescent lamps, and vehicle <br />batteries. Refuse derived fuel or other material that is destroyed by incineration is not a <br />recyclable material. <br />C. "Dwelling Unit" is a single unit of housing, whether freestanding or within a building containing <br />other dwelling units, providing independent, living facilities for one or more persons, including <br />permanent provisions for living, sleeping, eating, cooking, and sanitation. <br />D. "Multi -unit residential recycling program" is a program serving apartment complexes, including <br />condominiums, with four or more dwelling units or mobile home parks. <br />
