COUNCIL MEETING JANUARY 23, 1995 <br />for the improvement of Holly Drive/12th Avenue. <br />There were no further questions from the City Council and no <br />action was required at this time. <br />Verbal Status Report, Well No. 3 - Mr. Powell explained that on <br />September 21, 1994, the City Council order plans and <br />specifications and authorized acquisition of property by eminent <br />domain for well No. 3. Experience last summer indicated a <br />definite need for another well in the City. The process of <br />putting another well on line was begun last fall in order to have <br />the well ready to go when the peak water demand comes in the <br />summer. <br />At that time three (3) well sites were identified with the Apitz <br />site on Birch Street being the preferred site. At that time Mr. <br />Volk and Mr. Steve Heth attempted to contact Mr. Apitz or his <br />designated representative. There were some preliminary <br />discussions but ultimately SEH had to look for another site on <br />which to locate this well. Another site has been identified and <br />the property owner has agreed to the location. The legal <br />description will be prepared by SEH and forwarded to the City <br />Attorney so that an appraisal can be prepared. <br />Mr. Powell explained that the proposed site is on the Agnes <br />LaMotte property on the south side of Birch Street and west of <br />the ditch near a large oak tree on some high ground. <br />CONSIDERATION OF APPOINTING A LEGAL NEWSPAPER, RANDY SCHUMACHER <br />Mr. Schumacher explained that the City's legal newspaper is no <br />longer in business. In order that we not be without a legal <br />newspaper, he recommended that the City Council appoint the Quad <br />Community Press as interim legal newspaper. When annual <br />appointments are considered in a couple of weeks, the Council can <br />evaluate the applications for this designation and appoint a <br />legal newspaper for 1995. <br />Council Member Kuether moved to appoint the Quad Community Press <br />and interim legal newspaper. Council Member Bergeson seconded <br />the motion. Motion carried unanimously. <br />CONSIDERATION OF RESOLUTION NO. 95 - 08 AUTHORIZING THE ISSUANCE <br />OF 1995 CERTIFICATES OF INDEBTEDNESS, RANDY SCHUMACHER <br />Mr. Schumacher explained that the 1995 budget called for the <br />issuance of certificates of indebtedness in the amount of <br />$176,000.00 to be used for the purchase of capital outlay. <br />PAGE 16 <br />
