COUNCIL MEETING JANUARY 23, 1995 <br />of a public hearing for well No. 4 should be delayed until that <br />time. Mr. Powell requested that only the feasibility report be <br />received at this time. <br />Council Member Elliott moved to adopt Resolution No. 95 - 07 <br />receiving the feasibility report for well No. 4. Council Member <br />Bergeson seconded the motion. Motion carried unanimously. <br />Resolution No. 95 - 07 can be found at the end of these minutes. <br />Verbal Status Report, Trapper's Crossing - Mr. Powell explained <br />that on August 8, 1994, the City Council approved the rezone to <br />PDO and the preliminary plat with conditions. One of the <br />conditions was a requirement of a satisfactory plan for the <br />reconstruction of Holly Drive and 12th Avenue be included in the <br />development agreement. On October 19, 1994, SEH completed a <br />traffic study to determine the effect Trapper's Crossing had on <br />the Holly Drive/12th Avenue traffic. A copy of the report was <br />submitted to the developer. The developer has submitted a <br />request to extend the final plat filing deadline. (There is a 90 <br />day requirement between preliminary and final plat approval by <br />the City Council). On December 12, 1994, the City received a <br />letter from the developer with his attorney's opinion on the cost <br />sharing legality and requesting a meeting to discuss the <br />developer's attorney's concerns. The concern was to what extent <br />would the developer be responsible for the cost of the <br />improvements to Holly Drive/12th Avenue. <br />On December 22, 1994, City staff met with the developer. SEH <br />submitted estimated the feasibility report preparation costs. <br />The two (2) feasibility reports that would be prepared are for <br />12th Avenue improvements and the subdivision itself to evaluate <br />utility service and drainage. Staff indicated to the developer <br />that a feasibility study would have to be prepared on the Holly <br />Drive/12th Avenue project to determine what project costs might <br />be involved and to what dollar extent he would be required to <br />contribute to those improvements. <br />As of this evening, the feasibility reports have not been <br />started. The City's participation in the Holly Drive/12th Avenue <br />feasibility costs should be determined by Council policy which <br />will be discussed at an upcoming Council work session. The <br />question to be answered is to what extent does the City benefit <br />from the report once it has been prepared and if the City should <br />participate in the cost of preparing it. Since the City has no <br />existing policy regarding City participation in the cost of any <br />feasibility study preparation, staff is requesting guidance from <br />the Council as to what would be allowed in this area.
