JUN -07-1996 12:02 NAC 612 595 9837 P.02 <br />Recommendation <br />The City's 1991 Comprehensive Plan suggests commercial use of the subject property. <br />While the down zoning of property is commonly discouraged within the City (unless a land <br />trade is negotiated) a rezoning of the eastern portion of the subject property may be <br />justified in consideration of the site's context and physical characteristics of the site. Also <br />to be noted is that the area in question is to be subject to specific study as part of the <br />Comprehensive Plan Update. In this light, rezoning at this time may be considered <br />premature. Matters of land use appropriateness are, however, considered City policy <br />issues to be determined by City officials. <br />If the City finds the proposed R-1X/PDO rezoning to be acceptable, it should be approved <br />only upon fulfillment of the following: <br />• The necessary Comprehensive Plan amendment is approved by the Metropolitan <br />Council. <br />• The City approve the proposed subdivision (parcel must be created to which R -1X <br />zone is to be applied). <br />Should the City approve the requested rezoning, our office recommends approval of the <br />Surfside Addition preliminary plat subject to the following conditions: <br />1. The preliminary plat is revised such that Lot.6 and Outlot A are combined with the <br />adjacent Surfside Seaplane base property. <br />2. Hanger building materials and heights are specified and found to comply with <br />applicable City requirements. <br />3. Seaplane hangers not exceed 2,400 square feet in size. <br />4. No detached accessory buildings other than the Seaplane hangers are allowed_ <br />5. A copy of restrictive covenants be applied to the proposed residential Tots are <br />submitted for City review and approval. Such covenants must address architectural <br />requirements for hangers and include a provision that such hangers are to be used <br />solely for airplane (seaplane) and related equipment storage. <br />6. It is demonstrated to the City that wetland boundaries have been delineated by a <br />qualified individual. <br />2 <br />
