for some flexibility in the use of the MUSA reserve. The following <br />parameters were used as guidelines for identifying the future urban <br />expansion limits and will also serve to guide the distribution of <br />the MUSA land reserve in a manner that promotes staged, orderly <br />growth while maximizing the use of the MUSA allocation and <br />infrastructure. <br />1. The property is contiguous to the existing MUSA and provides <br />a logical extension of utilities in an orderly growth pattern. <br />2. Utility improvements respond to environmental, health, safety, <br />and general welfare concerns. <br />3. The potential sewer discharge of the project is within <br />limitations assigned to the City of Lino Lakes by regional <br />agencies. <br />4. The developer/benefitting property owners assume the <br />significant majority of improvement/service costs, and agree <br />to pay assessments associated with extending service to serve <br />their property. <br />5. The proposed MUSA expansion or trade is consistent with the <br />City's infill policy which encourages urban development to <br />locate wherever possible in areas where public investments <br />have already been provided. <br />6. In considering land trades, the City should not exchange <br />developable commercial or industrial zoned land for a proposed <br />residential development unless fiscal impact concerns are <br />fully addressed. <br />7. The developer acknowledges and holds all governmental units <br />harmless should limitations on sewer hookups and/or MUSA land <br />bank reserve be imposed. <br />8. The land does not qualify as a premature development or <br />subdivision based on the following: <br />a. Lack of adequate storm water drainage capacity. <br />b. Lack of adequate or safe water supply. <br />c. Lack of adequate roads or highways to serve the <br />subdivision or development. <br />d. Lack of adequate or safe sewage disposal. <br />e. Inconsistent with the Comprehensive Plan. <br />f. Lack of adequate public support facilities (i.e., <br />schools, parks and recreation, fire and police, etc.). <br />g Inconsistent with environmental protection policies. <br />22 <br />
