PLANNING & ZONING BOARD <br />April 12, 1995 <br />Mr. Mesich expressed concern regarding the MUSA amendment <br />and the land trade. He indicated if the MUSA exchanged <br />is not approved, the second phase could not proceed and <br />that would jeopardize the support for utility extension. <br />Mr. Brixius indicated if the Metropolitan Council <br />approves the MUSA land exchange, they would do so only if <br />they felt comfortable they would be also approving the <br />MUSA Land Amendment. Therefore he did not have any <br />concerns. <br />Discussion was held regarding utility extension and the <br />expense. <br />Mr. Mesich expressed concern that the City would handle <br />the costs of the extended utility, and not receive <br />reimbursement if the MUSA exchange was not approved. <br />Mr. Powell in reference to Mr. Mesich's concern indicated <br />Mr. Uhde would accept all risks involved for the <br />assessments of utility extension, he will be responsible <br />for the assessments regardless of lot sales. <br />Discussion continued regarding assessments. <br />Chair Schaps indicated the Board will take action on each <br />item in the order presented by Mr. Brixius. <br />Bill Johnson made a MOTION to approve the Comprehensive <br />Plan Amendment, subject to Metropolitan Council approval, <br />and was supported by Rick Gelbmann. All voted aye. <br />Motion carried. <br />Al Robinson made a MOTION to approve Rezoning of northern <br />portion of the site (Airpark lots) from R, Rural to R-1, <br />Single Family Residential with stated conditions, subject <br />to City staff review and City Council approval, and was <br />supported by Guy Herr. All voted aye. Motion carried. <br />Rick Gelbmann made a MOTION to approve PDO overly of <br />those lots provided Airpark access with noted amendments <br />subject to City staff review and City Council approval, <br />and was supported by Bill Johnson. All voted aye. <br />Motion was carried. <br />Mr. Brixius indicated the conditions will be clearly <br />defined by staff and reviewed with the applicant, then <br />forwarded for City Council approval. <br />Al Robinson made a MOTION to approve the Preliminary Plat <br />with conditions regarding lot #18, "butt" lot to be <br />removed and cul-de-sac included, subject to City staff <br />review of definitions and City Council approval, and was <br />supported by Bill Johnson. Vote: 5 ayes - 1 nay. With <br />Tom Mesich in opposition. Motion carried. <br />9 <br />
