PLANNING & ZONING BOARD <br />JUNE 14, 1995 <br />Mr. Mesich indicated he would prefer to see three sites <br />than two. Mr. Mesich indicated there was a small loss of <br />land due to the construction of Highway 35. <br />Mr. Johnson inquired if there are any protected wetlands <br />on the property. Some wetland area may be present on the <br />western portion of the lots, near the freeway and <br />adjacent to the creek/ditch. <br />Mr. Brixius encouraged the Planning Board to approach the <br />variance request with caution. He noted the Planning <br />Board must justify the variance based on findings. He <br />indicated perhaps rationale for the variance could be the <br />reduction in land due to the freeway construction. <br />Ms. Wyland indicated she was unsure if the current owner, <br />owned the land during the time of construction of the <br />freeway. <br />Chair Pro -Tem believed the Board should stay within the <br />10 acre requirements. <br />Ms. Wyland indicated staff does not encourage variances. <br />Mr. Herr inquired if there has been other variance <br />requests in the past regarding the 10 acre lot size, <br />where a variance has been granted. Ms. Wyland indicated <br />not to her knowledge has any variance request regarding <br />this been approved. <br />Ed Schones made a MOTION to deny subdivision of property <br />into three parcels. Approving a split of the property <br />into one 10 acre parcel and one 19.4 acre parcel. Two <br />Park Dedication fees to be collected at the time the deed <br />is signed by the City for recording with the County, $500 <br />per lot and was supported by Bill Johnson. All voted <br />aye. Motion carried. <br />E. 95-18 P/Z, Willow Ponds, Elm Street, Preliminary Plat <br />& Rezoning - PUBLIC HEARING. <br />Chair Pro -Tem OPENED the Public Hearing at 8:29 p.m. <br />Planning Consultant Brixius presented a brief staff <br />report regarding the request for Rezoning and Preliminary <br />Plat approval. <br />Mr. Brixius indicated Cottage Homesteads of America <br />received site plan approval at the May Planning and <br />Zoning Board and City Council meetings for a 47 unit <br />senior rental project. <br />Mr. Brixius indicated staff would recommend approval of <br />the requested rezoning from R-4/PDO to R-1, Single Family <br />11 <br />
