AGENDA ITEM V G. <br />STAFF ORIGINATOR Mary Kay Wyland <br />DATE August 8, 1994 <br />TOPIC 94-19-C, PUBLIC HEARING, Al Robinson, 401 Main <br />Street, Conditional Use Permit for Land <br />Reclamation <br />IOUND <br />This case involves a request to deposit approximately 50,000 cubic <br />yards of "topsoil" 20-25' in depth to be used as coverage for a 5 <br />acre area. The material will be stored temporarily (up to three <br />years) and used as top soil for the existing landscaping business <br />both for resale and re -use on the existing sod fields. The material <br />will be coming from the Main Street reconstruction project. The <br />applicant intends to provide hale bales and silt fence as necessary <br />and seed/mulch the slopes. <br />The property in question is Zoned R, Rural and according to the <br />City Zoning Ordinance, Sec. 4, Subd. 33 Land Reclamation and Land <br />Grading, "...Land reclamation shall be permitted by conditional use <br />permit in all districts. Depositing a total of more than fifty <br />(50) cubic yards of material per acre, either by hauling in or <br />regrading the area, shall constitute land reclamation..."., <br />Notification has been made in the official newspaper and property <br />owners within 350' of the site have been notified of the request. <br />Staff has reviewed this request and would comment that the <br />following items need clarification prior to approval of the <br />conditional use permit; <br />1. A wetland delineation of the site. <br />2. Correspondence from the RCWD indicating whether or not a <br />permit is required from them. <br />3. Confirmation as to the quantity of material to be brought <br />in and a detailed grading plan. <br />4. Topsoil is intended to be stockpiled. Is this surficial <br />topsoil which is to be stripped off and then replaced on the <br />County project or is it a peat type material which will , be <br />mixed with other materials to meet a topsoil specification. <br />Would this mixing be done on the applicant's site? <br />5. Proper erosion control of site and stockpile as determined <br />by the City Engineer. <br />5. Seeding and mulching as recommended by the City Engineer <br />immediately following final grading. <br />1. Approve request with conditions <br />2.
