D. Develc ::en t Righty. To accommodate the proposed <br />development, an R-1 zoning, designation will be necessary. <br />It should be recognized that the "R-1" District holds <br />different development performance standards than the "R" <br />District zoning which bounds the site (i.e., accessory <br />building standards, etc.). As such, a determination <br />should be made as to whether the expansion of the "R-1" <br />District will negatively impact the surrounding "R" <br />District or vice versa. <br />3. HOW WILL THE PROPOSED DEVELOPMENT IMPACT PUBLIC SERVICES? <br />To accommodate the proposed development, public sewer service <br />will be necessary. As part of the City's consideration of the <br />proposed development, the following utility service related <br />items should be considered: <br />A. $epti9 System Failures, As noted previously, sewage <br />treatment system failures have been documented in the <br />area. Such facilities raise genuine public health <br />concerns in regard to potential ground water pollution. <br />While such systems likely require replacement, associated <br />costs may make such action difficult. The ultimate <br />solution to failing systems may be the extension of <br />public sewer. The City must evaluate how this may be <br />implemented in the future. <br />B. ,rawer plan. The subject property lies within Sewer <br />District #2 as identified in the City's 1990 Sewer Plan <br />(see attached Exhibit C) . To accommodate the proposed <br />use, an amendment to the plan would be necessary. <br />C. Charter Agreements, As mentioned previously, a City <br />charter agreement states that property owners may hook up <br />to city sewer service at their discretion. As such, <br />property owners have a right to refuse associated <br />assessment costs. <br />D. proposed Utility Extension, The applicant has proposed <br />to extend sanitary sewer service northward along 4th <br />Avenue and westward along Lilac Street at his sole <br />expense. As such, area property owners would not be <br />required to pay for such an extension unless they request <br />connection to the facility. The applicant has indicated <br />the cost of utility extension has mandated the proposed <br />residential density. The extension and sizing of <br />proposed utilities will provide utility capacity for the <br />surrounding proprieties without expense to the City. <br />3 <br />
