Nave <br />Staff members present: City Attorney, Bill Hawkins; City <br />Administrator, Randy Schumacher and Clerk -Treasurer Marilyn <br />Anderson. <br />The purpose of the closed session was to discuss the Reshanau <br />Park Estates Homeowner's Association (RPEHA) litigation. <br />Mr. Hawkins explained that Mr. Schumacher and a City Council <br />member have been informed of allegations that he, acting as the <br />City Attorney, made to the attorney for the RPEHA. Mr. Hawkins <br />told the City Council that from the beginning of the boat launch <br />matter, he has told the City Council that they have the right to <br />deny the request for the boat launch. This opinion was given in <br />writing and remains his opinion today. <br />Mr. Hawkins explained that there are certain sanctions applied to <br />City Attorneys. He read these sanctions. Mr. Hawkins explained <br />that the allegations are absolutely nonsense. He has 20 years of <br />experience in this field and knows how to hand litigation. He <br />explained that he never even remotely indicated that the City's <br />case is frivolous. <br />Council Member Kuether explained that the word "frivolous" was <br />used in a conversation she had with a RPEHA Member. She told the <br />RPEHA Member that her attorney should come before the City <br />Council and relate this information. <br />Mr. Hawkins said that he was "extremely distraught" that this <br />allegation was brought up at a public meeting (July 21, 1993 <br />Council Work Session) especially after it was explained that the <br />allegation was completely untrue. He said that since the City is <br />involved in a lawsuit on the matter, the City Council and staff <br />PAGE 1 <br />
