Mr. Hawkins again said he feels that this is not <br />a "frivolous" case and is prepared to go forward with the <br />litigation. <br />Council Member Elliott was called by the same RPEHA Member <br />regarding the same matter, however, she was not given the same <br />information regarding the allegation against Mr. Hawkins. <br />Mayor Reinert requested that both staff and City Council not talk <br />to any RPEHA Member on this matter, but refer them to Mr. <br />Hawkins. Council Member Kuether felt this was a tough situation <br />because the Council Members are taxpayers too. However, she <br />noted that the City is in litigation on the matter. <br />Council Member Bergeson explained that the same RPEHA Member had <br />also called him. However, the purpose of the call was to let him <br />know that illegal things were happening on a lot down the street <br />from his house. He told the RPEHA Member to call the Police <br />Department or the Building Department and report the incidents. <br />This RPEHA Member then called Council Member Neal. <br />Council Member Neal explained that the same RPEHA Member called <br />him and told him about the conversation that Mr. Hawkins <br />allegedly had with the RPEHA's attorney. Mr. Hawkins told <br />Council Member Neal that he should have brought the allegations <br />to him and not to an open Council meeting. Council Member Neal <br />explained that he had called Mr. Hawkins' secretary and found <br />that there was no truth to the matter. He then related this <br />information to the RPEHA Member at the work session. <br />Mayor Reinert reminded the City Council that the City is in <br />litigation on this matter and all members should be united. Mr. <br />Hawkins suggested that if any Council Member is approached on <br />this matter in the future, they should explain that the <br />allegations are untrue and since the City is in litigation there <br />will be no further comments. <br />Mr. Hawkins updated the City Council on the litigation matter <br />explaining that criminal action against the City has been <br />dropped. He also explained that the RPEHA has not yet retained <br />an attorney to answer the lawsuit prepared by the City against <br />the Association. <br />Again Mr. Hawkins explained that his obligation is to the City <br />and he will try to settle the matter in the best interest of the <br />City. He also explained that just because he is trying to settle <br />the case without going to court does not mean that he considers <br />the matter "frivolous". <br />PAGE 2 <br />
