COUNCIL MEETING FEBRUARY 27, 1995 <br />this project and the public hearing has just been completed. He <br />explained that preparation of plans and specifications can begin <br />upon receipt by the City Council of adequate financial security <br />from the developer. The developer is willing to present the <br />financial security immediately to keep this proposed improvement <br />project moving forward. Mr. Powell also explained that the City <br />cannot order the project for 60 days, however the developer will <br />be submitting a waiver of 50 of the 60 days. If the waiver is <br />received, the City Council can order the project at the March 13, <br />1995 Council meeting. <br />Council Member Kuether moved to adopt Resolution No. 95 - 26 <br />Ordering Plans and Specifications for Woods of Baldwin Lake, <br />Second Addition and dispense with the reading. Council Member <br />Elliott seconded the motion. Motion carried unanimously. <br />Resolution No. 95 - 26 can be found at the end of these minutes. <br />Consideration of Resolution No. 95 - 24 Setting Public Hearing to <br />Vacate a Certain Drainage Easement on Lots 5 and 6, Block 2, <br />Rohavic Oaks, Second Addition - Ms. Wyland explained that the <br />vacation of a drainage easement through Lots 5 and 6, Block 2, <br />Rohavic Oaks, Second Addition is necessary to clear the title for <br />these two (2) properties. This easement was recorded as the <br />southwesterly 15 feet of Lot 17, Block 2, Rohavic Oaks which was <br />subsequently replatted as a portion of the Rohavic Oaks, Second <br />Addition and never vacated when the new plat was approved. <br />The City Attorney has recommended that this item be continued to <br />the March 27, 1995 City Council meeting. Notification in the <br />legal newspaper referenced a St. Paul Water Utility easement <br />when, in fact, this easement relates to a City of Lino Lakes <br />easement for drainage purposes. <br />At this time it would be appropriate for the City Council to <br />adopt the attached Resolution No. 95 - 24 setting a public <br />hearing for Monday, March 27, 1995, 6:30 P.M. to consider the <br />vacation of this drainage easement. <br />Council Member Kuether moved to adopt Resolution No. 95 - 24 <br />Setting Public Hearing to Vacate a Certain Drainage Easement on <br />Lost 5 and 6, Block 2, Rohavic Oaks, Second Addition. Council <br />Member Bergeson seconded the motion.
