1 Requirements for filing written documentation (e.g. location <br />2 maps) with the PUC and Local Authorities by every Person, <br />3 including Local Authorities. providing Emerging <br />4 Communications Services which identifies all wires. conduits or <br />5 other equipment necessary for the purpose of constructing, <br />6 operating. maintaining. offering or delivering the Emerging <br />7 Communications Services which are placed under. above or on <br />8 Public Property or Public Rights -of -Way. <br />9 Subdivision 3. Nothing in this Chapter shall diminish. limit. or otherwise restrict the <br />10 existing authority of cities relative to any corporation or other business association <br />11 organized to construct. acquire. maintain; or operate telephone lines, as such authority <br />12 exists as of the effective date of this Act. <br />13 Section 6. [237A.06] [COMPENSATION FOR USE OF THE RIGHT-OF-WAY.] <br />14 Subdivision 1. The Local Authority may charge and collect reasonable Permit fees <br />15 sufficient to recoup the costs of regulation. Such fee may include not only the actual <br />16 costs of permitting. but all expenses associated with the monitoring of Permit <br />17 compliance, costs associated with enforcement of PUC regulations and any diminution <br />18 of value of Public Property or Public Rights -of -Way as a result of the installation <br />19 upon or continued occupancy of Public Property or Public Rights -of -Way. <br />381648 - February 9, 1995 - Page 13 <br />Prepared jointly by the law firms of Fredrikson & Byron and Bernick and Lifson <br />
