COUNCIL MEETING APRIL 24, 1995 <br />building lots per year. <br />Mayor Reinert referenced the nine (9) Lino Air Park lots and <br />asked if a homeowners association would be formed for these lots. <br />Mr. Uhde explained that there is an existing homeowners <br />association in place and the Air Park lots will become a part of <br />the existing association with additional rules and by-laws. The <br />new lots will be of a different size and will require stricter <br />covenants. The parcel under the PDO is the only parcel in Behm's <br />Century Farms that will have a homeowners association. <br />Mayor Reinert noted that some associations have been created in <br />the City that have caused problems for the City Council. He said <br />that the City does not want any more of these associations. <br />Mayor Reinert asked Mr. Brixius if he had seen the by-laws that <br />are being proposed for the Lino Air Park lots. Mr. Brixius said <br />no, he has expressed these concerns to Mr. Johnson and has <br />requested that the by-laws and regulations be formally submitted <br />to staff for their review and written opinion. If the City <br />Council approves the first reading of the rezone and PDO request <br />tonight, staff is asking that the plan of action for these lots <br />be submitted and staff provide a formal opinion before the second <br />reading. Mayor Reinert said that he is concerned about how <br />homeowner associations as designed and their impact on the <br />neighborhood. Mr. Uhde said that he understood and pointed out <br />that this particular association is an established association. <br />He said that he is taking a possible existing platted 19 lots <br />that would be part of the homeowners associating and cutting them <br />down to nine (9) lots. He said he will be reducing the size of <br />the association, and overlying additional rules, regulations and <br />disclosures. It is Mr. Uhde's intent to eliminate any further <br />controversies in the future. Mr. Uhde said this organization <br />already exists and he will only be making the regulations for his <br />lots stricter. Mr. Brixius explained that Mr. Uhde will not be <br />creating larger rural lots and staff is concerned about creating <br />a neighborhood rather than just the use of the Air Park. Staff <br />will be looking at rules regarding maximum hangar size, specific <br />location of the hangars, specific statements that the hangars <br />will not be used for commercial or rental use, maximum building <br />heights, no fuel or limited fuel storage, how guest airplanes are <br />going to be treated, limiting the number of airplanes per lot, a <br />green space requirement for each lot, disclosure of the Air Park <br />requirements that currently exist, the Air Park will continue to <br />exist as an operating facility so that the people who purchase <br />lots in the subdivisions beyond the nine (9) Air Park lots will <br />know that this is an on-going operation and the lot that they are <br />buying will be in close proximity to someone who flies airplanes. <br />Another issue discussed by the P & Z Board is the specific <br />location of the joint taxi areas.
