The conveyance would take place when the new lift station becomes fully operational and, because the <br />proposed interceptor and lift station facilities will have been fully depreciated by the time the new lift station <br />has been completed, the facilities would be conveyed at no cost to the City. <br />In addition, as part of the metropolitan system serving lino Lakes, the MWCC had entered into an Agreement <br />with Lino Lakes to share on an annual basis operation and maintenance costs of a Lino Lakes lift station. When <br />the new MCWS lift station becomes operational, the MCWS will no longer need the services of the Lino Lakes <br />lift station. The City of Lino I aces is planning to build a new lift station in the summer of 1995 to replace the <br />lift station subject to the agreement. As part of the conveyance of excess facilities to Lino Lakes, MCWS has <br />proposed that the maintenance agreement be terminated effective at the end of 1996 and that MCWS pay <br />$22,000 (average annual operating fees for 1995 and 1996) to Lino Lakes immediately for use by Lino Lakes <br />in constructing its new lift station. <br />Finally, the Council approval of the Facility Plan for Lino Lakes was conditioned upon resolution of cost- <br />sharing issues. The design alternative for location of the new lift station which would have required cost- <br />sharing was eliminated from consideration by MCWS. There are, therefore, no cost sharing issues at this time. <br />RECOMMENDATION: <br />1. That the Metropolitan Council declare that upon full operation of MCWS Project 91-06, a certain <br />portion of the Lino Lakes Interceptor system will no longer be necessary for the metropolitan <br />interceptor system. <br />2. That the Metropolitan Council authorize the Regional Administrator to enter into an Agreement to <br />convey to the City of Lino Lakes, at no cost to Lino Lakes, that portion of the Lino Lakes Interceptor, <br />Project 76-50, determined to be no longer necessary for the metropolitan interceptor system. Such <br />conveyance will take place upon MCWS Project 91-06 becoming fully operational. <br />3. That the Metropolitan Council terminate the Land Use Agreement with the City of Lino Lakes <br />effective December 31, 1996 for the cost of $22,000 to be paid immediately. <br />-2- <br />
