AGENDA ITEM 5 B <br />STAFF ORIGINATOR Mary Kay Wyland <br />DATE March 24, 1995 <br />TOPIC Shoreland Management Ordinance <br />First Reading Ordinance No. 04-95 <br />BACKGROUND <br />Minnesota Statutes has mandated that the City update their existing <br />(1983) Shoreland Management Ordinance. The purpose of the <br />Ordinance is to provide for the wise subdivision, use and <br />development of shorelands of public waters. These shorelands can <br />be described as an area roughly 1000' from the ordinary high water <br />mark of the protected waters listed on pages 8 and 9 of the <br />Ordinance. A Model Ordinance was provided by the DNR and intended <br />to be used as a guide. The DNR allows communities to pursue <br />flexibility from the State Model Ordinance to address conditions <br />unique to the City. <br />City Staff has worked closely with DNR Staff in developing the <br />attached ordinance and have received a favorable response to our <br />request for flexibility. This flexibility was requested in order to <br />maintain sustainable growth within the City and relates to the <br />following areas. <br />Land Use Designations <br />Lot Size <br />Density <br />Impervious Surface Coverage <br />Building Heights <br />Sanitary Sewer Connection <br />Shoreland Setback for Uses without Water Oriented Needs <br />LAND USE DESIGNATIONS: The City has requested the Land Use <br />Designations to compare with our base zoning districts. <br />LOT SIZE: Lot area and width standards are significantly less <br />restrictive than the state standards. We have requested standards <br />that relate again to our base zoning district (10,800 sq. ft. area <br />for R-1 non -riparian lots, 20,000 sq. ft. for riparian lots while <br />the DNR Model requested 15,000 sq. ft. area for non -riparian and <br />20,000 sq. ft. for riparian). <br />Flexibility was requested due to the short supply of buildable land <br />resulting from the high percentage of state right-of-way, county <br />park, wetlands and lakes within the City. As a condition of <br />approval for this flexibility request, the DNR has asked that our <br />ordinance include a statement which prohibits total district -wide <br />density from being exceeded. We have included such a provision. <br />DENSITY: The DNR Model provided a complicated tier arrangement for <br />calculating density for multi -family developments.
