STATE OF MINNESOTA DISTRICT COURT <br />COUNTY OF ANOKA TENTH JUDICIAL DISTRICT <br />PAUL HOWARD and RUTH HOWARD, Case Type: Land Use <br />husband and wife, File No. C8-90-11907 <br />Plaintiffs/Petitioners, <br />vs. <br />SETTLEMENT AGREEMENT <br />THE CITY OF LINO LAKES, a <br />municipal corporation, <br />Defendant/Respondent. <br />WHEREAS, Paul and Ruth Howard, (hereinafter the "HOWARDS"), <br />commenced the above action, (hereinafter the "LAWSUIT"), against <br />the City of Lino Lakes, (hereinafter the "CITY"); and <br />WHEREAS, the Howards are the owners of certain real property <br />(hereinafter the "SUBJECT PROPERTY") located within the City limits <br />of Lino Lakes with a legal description as follows: <br />Lot 12 and 13 of Arthur E. Thom Acres <br />according to the plat with the Anoka County <br />Recorder's office. <br />WHEREAS, the Howards have submitted an application to the City <br />to rezone the subject property from R-1 to R-6; and <br />WHEREAS, the Howards have agreed to modify their original <br />proposal and submit it to the City; and <br />WHEREAS, the parties to this lawsuit desire to settle the <br />claims between themselves upon the following terms and conditions; <br />G: \ W PDATA12266-027\S ETT2130.
