NOW, THEREFORE, IN CONSIDERATION OF THEIR MUTUAL PROMISES AND <br />COVENANTS HEREIN, THE PARTIES HERETO AGREE AS FOLLOWS: <br />1. The Howards will prepare a site plan and rezoning application <br />to rezone the property from R-1 to R-6 conforming to the <br />Ordinances of the City of Lino Lakes, including the following <br />elements: <br />(a) The Howards will prepare and submit a landscape plan <br />showing in detail the landscaping as generally depicted <br />on the plan dated 11/4/91 prepared by <br />B. B. Chapman, A.I.C.P., St. Paul, Mn. <br />In addition to the items shown on the general plan, the <br />plan will include an evergreen buffer on the south <br />boundary of the property, with every third evergreen tree <br />in the buffer a minimum of 12' in height, all other trees <br />will be a minimum of 7' in height. <br />(b) The manufactured home park will have four entrances to <br />Highway 49 and a connecting road between the proposed <br />cul-de-sac and the street immediately to the north as <br />shown in the plan dated 11/4/91 prepared <br />by B.B. Chapman, A.I.C.P., St. Paul, Mn. <br />(c) Howards will allow the placement of only double wide <br />manufactured homes (with minimum dimensions of 24 x 40 <br />and minimum square footage of 960) on the south side of <br />the subject property in the area outlined in blue on the <br />attached Exhibit A with a maximum number of eleven such <br />homes in said area, provided all setback and other <br />ordinance requirements are met. <br />(d) The City will be granted a sewer easement in the private <br />street, to be constructed as part of the Howard's <br />proposal. <br />(e) The Howards shall execute a document in a form prepared <br />and/or approved by the City Attorney to allow the City to <br />connect to and use the trail system highlighted on the <br />attached Exhibit A. The City may access said trail <br />system in the event the City constructs its own trail <br />system which could connect to the private trail. <br />2. Consideration of the modified site plan and rezoning request <br />will be considered by the Planning Commission and City Council <br />in accordance with its standard hearing and other procedures. <br />3. The Park Commission will review and determine the park <br />dedication fee in accordance with City policy. <br />
