The first phase of the project <br />included 110 residential dwelling units and was exempt from the provisions of the City's <br />recently adopted Shoreland Management Ordinance (adopted in April of 1995). At the <br />time of Phase I approval, it was specified that future Phase II development would need to <br />adhere to the provisions of the newly adopted shoreland requirements. At this time, the <br />developers wish to proceed with approval of Phase II of the development, which includes <br />two twelve -unit townhome structures (24 total units) located in the southern portion of the <br />site. <br />The subject property is zoned R-4, High Density Residential and lies within the Shoreland <br />Overlay District of Marshan Lake. <br />By definition, the proposed development qualifies as "planned development overlay" and <br />requires the processing of a conditional use permit. <br />Attached for reference: <br />Exhibit A: Site Location <br />Exhibit B: Previously Approved Site Plan <br />5775 WAYZATA BOULEVARD, SUITE 555 ST.
