CITY OF LINO LAKES <br />RESOLUTION NO. 17-61 <br />RESOLUTION APPROVING THE FINAL PLAT FOR CHAVEZ PRESERVE <br />WHEREAS, the City received an application for final plat approval for Chavez Preserve <br />hereafter referred to as "Development"; and <br />WHEREAS, City staff completed review of the proposed "Development" based on the <br />following information: <br />• Civil Plans, prepared by Plowe Engineering date May 26, 2017 <br />• Lot Tabulation dated May 26, 2017 <br />• Stormwater Drainage Report, prepared by Plowe Engineering dated May 24, 2017 <br />• Preliminary Plat, prepared by E.G. Rud & Sons dated April 18, 2017 <br />• Engineer's Cost Estimate dated April 18, 2017 <br />• Title Commitment, prepared by First American Title Insurance Company dated <br />April 6, 2017; and <br />WHEREAS, the preliminary plat was approved by the City Council on September 12, <br />2016 with Resolution No. 16-90; and <br />WHEREAS, the Planning & Zoning Board reviewed and recommended approval of final <br />plat on June 14, 2017; and <br />NOW, THEREFORE BE IT RESOLVED by the City Council of The City of Lino <br />Lakes hereby makes the following: <br />FINDINGS OF FACT <br />1. The final plat substantially conforms to the approved preliminary plat subject to the <br />conditions listed below. <br />2. The City Attorney approved the status of title/property ownership related to the <br />final plat. <br />3. A Development Agreement has been completed. <br />4. Conditions attached to approval of the preliminary plat have been fulfilled or <br />secured by the Development Agreement. <br />5. All fees, charges and escrow related to the preliminary or final plat have been paid <br />in full. <br />BE IT FURTHER RESOLVED by the City Council of the City of Lino Lakes hereby <br />approves the Final Plat for Chavez Preserve, subject to the following conditions: <br />1. All comments from City Engineer letter dated June 9, 2017 shall be addressed. <br />2. A Development Agreement shall be executed by the City and the developer and <br />recorded by the developer. <br />1 <br />
