COUNCIL MINUTES September 12, 2016 <br />APPROVED <br />`87 iii) Consider 2nd Reading of Ordinance No. 08-16 Vacating Drainage and Utility <br />88 Easements, Outlot B and Outlot D of The Village No. <br />89 Kendra Lindahl of the consulting firm Landform, noted the actions before the council. She reviewed the <br />90 history of the councii's action to date. Her PowerPoint presentation covered the following <br />91 - Proposed site and existing conditions; <br />92 - Construction of roadways; <br />93 - Landscape plan that outlines phasing; <br />94 - Easement vacation that is included. <br />95 Ms. Lindahl explained that based on the council's discussion about allowing vinyl siding, the developer <br />96 has agreed to add an element of "Hardie board" siding. <br />97 She explained that the requested action includes approval of a final plat and plan, final development <br />98 development agreement and an ordinance approving a vacation. <br />99 Community Development Director Grochala noted that the development agreement follows the city's <br />100 standard model and provides certain securities for the city. He also noted park dedication fees that will <br />lol be received and that a park lot will be developed within the area. Noted also are the inclusion of HOA <br />102 language, storm water management language, as well as inclusiona of a conservation easement. <br />103 Regarding the timing of the park, it will be developed soon and the plans are for a natural park that <br />104 makes use of existing nature features. The HOA does carry certain regulations included in statute and <br />' OS the developer ensures those are included in the HOA documents. <br />106 <br />107 Council Member Kusterman moved to approve Resolution No. 16-100 as presented. Council Member <br />108 Maher seconded the motion. Motion carried on a voice vote. <br />109 <br />1 to Council Member moved to approve Resolution No. 16-101 as presented. Council Member seconded the <br />111 motion. Motion carried on a voice vote. <br />112 <br />113 Council Member Rafferty moved to waive the full reading of the Ordinance. Council Member Maher <br />114 seconded the motion. Motion carried on a voice vote. <br />115 <br />116 Council Member Rafferty moved to approve the 2"d reading and adoption of Ordinance No. 08-16 as <br />117 presented. Council Member Maher seconded the motion. Motion carried: Yeas, 5; Nays none. <br />118 B) Chavez Preserve <br />119 i) Consider Resolution No. 16-90 Approving Preliminary Plat <br />120 ii) Consider Resolution No. 16-104 Approving Accessory Structure Agreement <br />121 City Planner Larsen reviewed a PowerPoint presentation covering the following: <br />122 - Background (size, location, properties in area); <br />123 - Current structures on lot (to be moved); <br />24 - Proposed lots; <br />
