COUNCIL MINUTES September 12, 2016 APPROVED 125 - Planning and Zoning Board review (in compliance with city guides); 126 - Density of development; 127 - Zoning implications; 128 - Stormwater management recommendations; 129 - Cash in lieu of dedication fees; 130 - Accessory structure agreement (allowing existing to remain on site for a certain period); 131 - Environmental Board review (no concerns); 132 - Public hearing comments (tree removal, landacaping and building design standards). 133 She reviewed the council actions requested. 134 Mayor Reinert asked if there were any resident issues (from those living in the area). Ms. Larsen 135 reiterated the public hearing comments included in the report, regarding trees and building standards. 136 The type of home will be similar to those already built in the area. 137 Mayor Reinert asked if there are any concerns about drainage changes. Ms. Larsen suggested that any 138 issues seen in the past have pretty much been resolved and she isn't aware of any current issues. Mayor 139 Reinert suggested that when there are such issues, he wants people to know that the city will respond and 140 that is a promise that continues over time. 141 Council Member Manthey asked if White Pine Road will be disturbed and Ms. Larsen suggested any 142 disturbance would be minimal since the road is already there — mostly dirt moving and normal home 143 construction activities. 144 Council Member Kusterman moved to approve Resolution No. 16-90 as presented. Council Member 145 Manthey seconded the motion. Motion carried on a voice vote. 146 Council Member Kusterman moved to approve Resolution No. 16-104 as presented. Council Member 147 Manthey seconded the motion. Motion carried on a voice vote. 148 C) Consider 2nd Reading of Ordinance No. 0946, Amending City Code Section 1007 by 149 adding Section 1007.056 Opting -Out of the Requirements of Minnesota Statutes, Section 462.3593 150 — City Planner Larsen noted that the council previously reviewed and approved the Pt reading of this 151 ordinance that allows the city to opt out of the state approved allowance of certain accessory structures. 152 Staff feels there are too many unknowns with allowing this type of structure. 153 Council Member Rafferty moved to waive the full reading of Ordinance No. 09-16 as presented. 154 Council Member Maher seconded the motion. Motion carried on a voice vote. 155 Council Member Rafferty moved to approve the 2nd Reading and adoption of Ordinance No. 09-16 as 156 presented. Council Member Manthey seconded the motion. Motion carried: Yeas; 4; Nays, 1 (Maher). 157 D) Consider Resolution No. 16406, Calling the Public Hearing on the Proposed Assessment, 158 Otter Lake Road Extension -Community Development Director Grochala reviewd his written staff 0
