ACTION <br />CHAPTER 8 OF CITY CHARTER <br />MINNESOTA STATUTES CHAPTER 429 <br />Notice of Public <br />Hearings <br />After both petition and resolution: <br />Upon receipt of cost estimate, the council must <br />pass a resolution (by majority vote) setting the date <br />for a public hearing, specifying the time, place and <br />purpose of the hearing. The resolution must be <br />published twice, a week apart, and at least two <br />weeks before hearing. A copy of the resolution, <br />including estimated unit prices and total price, <br />must also be mailed to each benefited owner at <br />his/her last known address, at least two weeks <br />before the hearing. <br />A. After 100% Petition: <br />No public hearing required. Council must pass <br />resolution by majority vote determining whether the <br />petition is signed by the required percentage of property <br />owners. If that resolution is published, any appeal must <br />be served on city clerk within 30 days after date of <br />publication. <br />B. After resolution: <br />After receipt of feasibility report, the improvement <br />public hearing is scheduled (usually done by resolution <br />but may be set by staff). Notice of improvement hearing <br />must be published twice, a week apart, with the second <br />publication at least three days before the hearing. The <br />notice must state the time and place of hearing, the <br />general nature of the improvement, the estimated cost, <br />and area proposed area to be assessed. The notice must <br />also be mailed to the owner of each parcel proposed to be <br />assessed, including a statement that "a reasonable <br />estimate of the impact of the assessment will be available <br />at the hearing." For purposes of mailed notice, owners <br />are those shown on county property tax records. <br />Public Hearing <br />After both petition and resolution: <br />At public hearing, council must present a "special <br />assessment formula and an analysis of the <br />assessment income expected to offset the proposed <br />improvement cost." <br />After resolution only: <br />At the public hearing, a "reasonable estimate of the total <br />amount to be assessed, and a description of the <br />methodology used to calculate individual assessments for <br />affected parcels" must be available. <br />2 <br />
